Email from CRKT just now.
Suit dismissed, confidential, CRKT "satisfied".

So the "Virtual Fixed Blade" tagline associated with all LAWKS features was removed and CRKT didn't have to pay a dime to CS? I too am satisfied.

A quick search of the CRKT site reveals plenty of uses of that phrase. Honestly, no offense to the OP, if this is, indeed, accurate news I would bet a judge tossed the case.
 
No offense taken.

I do business with both companies, the email was headed Press Release, For Immediate Release, and "dismissed" was the word used.

Wow, CS mod was quick with the original "Press Release",.... where are they now that it's dismissed? I mean it would only be the admirable thing to do. Now that it's over how about some facts about the lawsuit CS Mod? They said they couldn't talk about it before.

Just looking for something more than heresay about this story that I have been following. How about a name? A press release? Anything? Five W's?

It's true. I've seen copies of the e-mail from CRKT at various places around the internet. Both sides are satisfied so that is good enough though there is a confidentiality (sp?) agreement in place.

It was a no win situation for Cold Steel. Even if they won the battle they certainly lost the war. All over the internet in places people could express their opinion Cold Steel was being slammed hard. More so than I've ever seen in this industry.

Deservedly so IMO. Pretending it was an altruistic act is what sealed it for me to be honest. Well Lynn, did you learn anything about the difference between customers and Cold Steel geeks who worship you? You rarely hear from the former.

I for one hate not buying Cold Steel products but hey... Some of us got to have our own ideas of right and wrong.

Glad it's over.

It's over then.

Now we can go back to our disdain of CS while secretly buying their products like usual.
 
Court Journal Entry: "STIPULATION to Dismiss Case pursuant to FRCP 41(a)(1)(A)(ii) filed by defendants Columbia River Knife and Tool Company"

FRCP 41(a)(1)(ii) provides for dismissal when an entry of dismissal is filed that is signed by all parties to the case.

As far as I can tell, both companies continue to use virtual/virtually.
 
Thanks. Wouldn't mind sharing where that Court Journal Entry came from, would you? Just one teeny weeny bit of corroborating evidence from somebody in this thread would be so darn cool. ;)

Perfect. :thumbup: Thanks! :) Guess we don't need confirmation from Cold Steel that the suit was terminated, do we? Nor do we need confirmation of what this suit was really all about . . . trademark infringement. And pretty much as I figured, no one from Cold Steel will ever be able to talk about it.

Bill Shakespeare said it best . . . full of sound and fury signifying nothing!

Those who hated them still hate them, those who like them still like them. There's no such thing as"bad" publicity.
Oh and the lawyers got to send a big fat bill.

Yep. Only question is, had the same amount of money been spent on marketing instead of attorney fees, would it have given CS more publicity than they achieved as a result of the suit? My hunch is that CS got a lot of bang for the bucks they paid their attorneys. And that may have been what was actually behind the suit all along. Or to put it another way, the suit could have been nothing more than virtual marketing from the outset. If I'm right about that and there really is no such thing as bad publicity, then I say well-played, CS. ;)

PS: I just realized that if the trademark infringement involved the use of the word "virtual", then Extrema Ratio isn't a target of a CS suit. They don't make a "virtual" fixed-blade folder, they make a "real" fixed-blade folder.
