CUDA MAXX in NYC?

Sorry 4 Ranges, I am going to leave this story where it is.
Give us a break, here. None of us know the guy. Believe 100% of what you see and half of what you hear. Even less on the web.

Hey man, believe what you want.

That is all.

That day there were probably 10 calls to the police about a man brandishing a knife on the subway, 5 calls to the FBI's terrorist-watch hotline, etc...

Thanks for the nearly content-free story. Really contributed to the ol' thread there.

Isn't the problem with carrying illegally in NYC was the mandatory sentencing laws for carry a concealed weapon? In other words, if you get pinched, the risk of jail time is much higher than in other places.

Concealed carry of a firearm has a mandatory 1 year sentence.

Concealed carry of any other restricted weapon (short of explosives) has a lot more wiggle room. Regular folding knives that are too long, double edged or what not is usually just confiscated. Usually, if you are a person with a "life" (job, credit rating, etc), the cops may just yell at you, take down your info "just in case" and let you go with the offending tool.

However, automatics, brass knuckles, and other assasination gear will land you in jail awaiting prosecution and jail time.

I have had the opportunity to go over the specific statutes with my PO friends.

Ok, I was reading Tactical Knives and the article on the last page was about the author saving himself with a CUDA MAXX when his bag got caught on the subway train. (on the ends, there are these 2 gates that prevent people from falling in) He cuts the bag strap and a woman stared @ him for possesing a knife. That's not my point though. The CUDA MAXX is 5.5 inches, correct? If so, isn't it illegal here in NYC with a 4" limit?

It could have been one of the custom Cuda MAXX's with a 4" blade. But as it has been said before, you can sometimes get away with carrying over the limit, as long as it isn't an auto. Besides, he couldn't be charged now. Carrying a concealed "weapon" but if it's legal to possess it in private is really un-punishable unless your caught red handed.

The real point is that the guy is still alive because he had the Cuda Maxx. To me this trumps everything else, including the law. Better to be under arrest than under the train.

If I had an auto OTF and the cop was there when I the bag caught the train, I would have used it.

So would I. Whats worse? Death or a misdemeanor?

Let's remember than the story would likely have had the same end-result if the guy was carrying a legal-sized knife. The knife is what saved him, not the 5" blade length. I'm pretty sure a (legal) Endura would have also done the job just fine.

So, the question is not "is it wise to carry a knife?" (of course the answer is yes), it is still "is it wise to carry a knife that is illegal in your jurisdiction?".
