I'm starting this thread for 2 reasons. First, to warn everyone about this scumbag and second, to add insult to injury to a wannabe scammer. The person in question is Brian Fortune. His address is:

Do not do any kind of deal with this guy. If you buy from him, you are supporting a thief. If you sell to him, you risk your item. You can do everything right and still get screwed. Our deal happened on ebay but I think it's worthwhile to expose scammers wherever they are. It might prevent someone here from getting scammed in the future.

Story is, I listed a knife up for a 7-day auction and bafcoincorporated ended up winning it on 9/17 for $610. He paid 5 days later on 9/22. I shipped it the next day with signature confirmation (tracking number: 9402109699938796913097) and it was delivered and signed for on 9/25. The next day, I get these 2 messages on ebay:

"Hi
I just received my package and I beleive you got your packages mixed up. Im a lirttle disapointed because Ive been waiting for my knife for awhile now and you sent me someone elses items. I wouldnt be so upset if this wasnt such an expensive purchase, but I spent a lot of money here to have something like this get messed up is just not professional at all! I was suppose to receive the red G&G Mud Knife with Carbon Fiber. I received a Protac 1AA Flashlight with serial# 046758 0811. I also received a Mossy Oak Brand Camo Money Clip. They were not packaged good at all either! Before I even opened the box i could hear and feel the items rattling around which had me really concerned before i even opened the box because I thought it was my $600 knife rattling around like that! CONTINUED ON NEXT MESSAGE

(READ PREVIOUS MESSAGE FIRST CONTINUED FROM LAST MESSAGE)I was already extremely upset as I was opening the package. There was nothing protecting the two items at all and I wouldnt think that you or anyone else would just throw such an expensive knife in a box and ship it out like that. Im suprised you even shipped a couple items like this out in such a way regardless if they are expensive or not. So i am very upset here for not receiving the correct item and and also because of the way you package your items! Can you please let me know whats going on. I hope you didnt send it to someone else and if you did I really hope you will be able to get the knife back. Please get back to me asap. Thank you."

It was badly written, got a few details wrong (knife was orange), and overall just seemed staged. I tell him I've never owned either of those 2 items, he paid 5 days late so it was shipped by itself, and that I would never package it like that. I ask him for photos, hoping he was just an idiot that got mixed up. He sends over some photos of his flashlight and money clip. One of them included the same shipping label I used to ship the knife (shown below). He opened a PayPal dispute the same day, placing the cash on hold. I realize he's abusing buyer protection and using it to try to scam me. I escalate it into a full claim.

The next couple weeks were hell. PayPal always favors the buyer so it was an uphill battle from the start. Then with the way he did this, I can't file an insurance claim, he just has to sit back while I waste my time, and in the end it was my word against his. I'm on and off the phone with PayPal regularly. Some representatives seemed like they genuinely wanted to help, while others just didn't care or wanted me to hang up. For the latter, I asked for a supervisor. I send over all the proof and evidence they ask for and on 10/6 they decide against me, telling him to "ship back" his $30 flashlight for a full refund. I almost lose it and call them again. A supervisor on PayPal said that it's already been decided and there wasn't anything he could do. But, he tells me to file an appeal, saying that it's part of the process and it's to ensure that I don't get hit with a chargeback since it undoes the original sale. I thank him for the info and end the call not knowing whether or not that was just some BS to pacify me.

10/12 comes around and I get his package. I open up an appeal after having to speak to another supervisor. They ask for an official government document so I file a police report and send it over. At this point, he's running around the the knife and my cash. They deny my appeal and closed it on 10/20. I call to reopen it the same day. I spend the next few days getting info and trying to figure out what went wrong. Then out of nowhere on Monday, I get an email saying that the case was decided in my favor.

To Brian Fortune: I WIN. Thanks for taking the time, money, and effort to ship me a free light. I hope you choke on the knife.
 
Wow, crazy story. I'm glad it worked out for you. I'm guessing he scammed multiple people and Paypal connected the dots?
 
Glad you are getting your money back! I hope PP (or eBay?) gets their money back from him. I wonder if he scammed someone else in a similar fashion and that is what changed their mind?

I have bought, but never sold on eBay, and this is one of fears if I ever do...

OP: I was incensed just reading the BS messages, Brian Fortune, sent you. :mad: I can only imagine how frustrating/maddening that is must've been for you trying everything in your power to persuade PP customer service. I'm so glad that in the end, you prevailed in your PP dispute! :) :thumbsup:

A quick google search shows a guy with substance issues and related arrests...linked in says he re-sells collectibles/antiques "cheap"...go figure.

I don't know for sure but I really wouldn't be surprised if he's done this before. I want to believe that someone at PayPal finally looked at the mountain of evidence I gave them but who knows. It was pretty clear who the scammer was and it was still touch and go for the most part.

I haven't used ebay for selling very often and it's going to be even less after this. It's great for buyers but not so much for sellers. It just sucks when you do everything right and it still blows up in your face.

KALAMA, I'm just glad this is all over. I'm been fighting this tooth and nail for little over a month now and hit a few low points along the way. 3 trips to my local police station and I've lost count on how many calls to PayPal. There were a couple of times where I would have thrown that $600 in the ocean if it meant he didn't get his hands on it.

rpn, now I wish ebay did background checks. Would have made things a bit easier for me. Recovering addict turned con artist huh. Not exactly an improvement...
 
My wife quit selling on eBay last year after getting too many PayPal claims for broken items, wrong items shipped, undisclosed defects, etc.

Small sellers are at the mercy of scammers. If you give negative feedback you get it in return.

Sorry you had to go through all that nonsense. Glad it worked out in the end. Hopefully karma will deal with that dude.
