I bought a mini Kershaw Cyclone from this guy and when I got it, it was not as described. It had rust on the blade, visable nicks in the edge, the box was ripped and crushed and had writing on it. The assist fuction doesn't seem to be working right and there are rub marks on the handle. Also, the liner is clearly worn from being opened and closed and used. It still locks up fine but it is clear that it is not a "new" knife by any stretch of the imagination.

I am not really picky about such things and I am sure there have been times when I bought knives that were called new but were used a bit or at least played with some and then passed along. That is one thing, this knife is damaged and looks bad. I bought it for one of my nephews as a X-mas gift but there is no way I can give this as a gift.

People know I am into knives and it would appear that I just gave him one of my old knives that I didn't want anymore. I think that is what the guy who sold it to me decided to do.

He also charged me $6.00 to ship it and then mailed it first class for about $1.90. That is pretty low as well.

When I asked for a refund, he said he can't refund shipping and I would have to pay to send it back as well. I think in a case like this, he should foot the bill for shipping since it was his fault I have to send it back.

I am opening a dispute with Paypal. I am not just going to send it back and pay over $10.00 in shipping just because some jerk decided to sell a used knife and call it new.
 
That sucks. What an A hole. I dont buy off ebay. This being the main reason. But you should report him, or whatever options you have through ebay so no one will buy from him anymore.
 
He responded to my Paypal dispute. Check out what he says:

"I offered you a full refund of the item and you denied it. I did admit to my mistake and I will return it.
I will make you a deal. I will pay you your refund once the knife is returned in the same condition as when I sent it to you, + I will send an additional $3.00 for shipping. That is extremely fair considering most merchents wouldn't even consider giving a refund on a deadly weapon! I will not refund all of the shipping money because it costs me to ship it to you!
"

He said he offered me a full refund but clearly he doesn't know what that means. A full refund means I get all the money I sent him back not some of the money.

It looks like anyway you cut it, I am going to loss money and time because I was unlucky enough to buy from a seller that was not honest about the condition of the knife he was selling.

It makes me wonder why he has a new E-bay account when he claims to have been on E-bay for years. It looks like he has done this kind of thing to other people and his account got closed or he decided to start a new one and start fresh.

I really like the comment about the "deadly weapon". What a jerk!
 
The seller sent you an obviously used and broken knife, and I wouldn't trust him any further. I think you'd be better off at this point using your shipping money to send the knife back to Kershaw for sharpening and repair.

yeah, they will fix it up to you real good. they sometime will even ship a new one out to you, who knows. ;)
 
Dont forget to leave the guy some terrible feedback! Or use it as leverage.

For what its worth, I would tell him that he is already proven to be untrustworthy so you cant take him up on his offer of a refund after he recieves it. So another solution needs to be thought up.
 
My best advice: Avoid "Evilbay" like the plague!!! The place is crawlin' with criminals. I've done business on there for about the last 6 years, and it finally got so bad, I just couldn't stomach it anymore. Used to be a good place to get a bargain, now it's a good place to get robbed.
As to "feedback", that's a joke. All the jerks do now is give retaliatory negatives to ruin your standing after you give them one. Report him, take your losses, and walk away.

Good plan...Kershaw just might suprise you, and send a new Mini-Cyclone to you to replace the bad one that you received from that crook at eBay...At the least, Kershaw will make yours look and fuction as close to new as it can be.

That's one of my major gripes about ebay "once you leave feedaback, I'll leave some" no, you leave feedback when I pay, I'll leave feedback when it gets here. grr. anyway, sorry that's OT.

thanks for the heads-up. perhaps there should be a sticky for bad ebay sellers?
