Ebay and their rules!

Well looks like Ebay pulled the plug on our auctions once again.

Why?

Because we sell autos and butterfly knives on 1SKS!

We did not list them on their site but they have a rule that you can not link to a site that does. What a joke.

Here is the email I got from them.

Don't get me started on eBay.... I don't think you have enough disk space for the rant that might result.

My suggestion to you is to make up some new business name, knivesLegalOnEbay.com, go to one of those free hosting places, and just put up a site that welcomes visitors and explains that to see the real stuff, they need to go to 1sks.com, but don't make that a link, just text. Sure, folks now have to type the URL, but eBay can't claim it as a link.

Boy, for years I have jokingly said that it's illegal to even think of a butterfly knife in California. I guess it's true. eBay does not allow listing of butterfly knives with blades in excess of two inches (and the two inch exception is a result of my explaining Cal law to eBay's lawyers). I am not aware that California law makes it illegal to discuss butterfly knives which is really all you're doing in posting a link to another site. This is sort of like suing Sports Illustrated because they ran an ad for the car that you bought which had a defective seat belt that resulted in your injury. You'd be holding SI responsible for something they had no part of. So how is eBay violating any law by happening to have a link to your page?

Oh well, as I say, don't get me started.

Ok, you got me started. I asked eBay's lawyers why they feel bound to apply California weapons laws to a transaction involving a seller in, for example, Idaho, and a buyer in, say, Oregon. Well, it's because eBay's equipment is physically located in California. So, don't you think that if Cal weapons laws apply, the Cal sales tax laws should also apply? They promissed to "look into that and get back to me." They never have.

eBay bends the law in other areas. You can sell beer on eBay, for example... as long as it's in a collectible can and the value of the item comes not from the beer, but from the can. So, by the same token, is not a $1500 Jody Samson kris balisong not so much a weapon but rather a collectible work of art? eBay considered this, but rejected it without comment.

Anyway, you got me started, and I'm holding back.

This is strange, since I use my website on eBay stuff just to generate interest and my website is an orgy of butterfly knives (over 380 pictures of butterfly knives, which, I will assert, makes it the internet's largest collection of butterfly knife pictures).

It took me awhile to make those auctions and they just deleted them. No warning, nothing. So ya I was pissed!

I have seen several items listed on E-bay that were also listed in their prohibited list. Someone had to report you to E-Bay for them to notice. I asked about an item months ago that was listed and the response I got was that the site was too big for them to police and they relied on people to report violations. I will have to check to see if I still have the e-mail.

Maybe that is why the dumped your auctions with a link while at the same time allowing an auction on a balisong. Do you really think the people at E-Bay took the time to reseach your link without someone first filing a complaint?

Just a thought.
 
I`ll bet your auctions would still be there if you hadn`t used the term "switchblade". Ebay will delete that every time, even if it is legal. Next time, call it an auto.
