Florida knife laws help.

My post referred to Miami-Dade. Hitherto, due to the current wording of the legislation, the right of a CCW holder to carry a knife in Florida does not pre-empt any of the restrictive county and municipal ordinances passed in Miami-Dade. I am not aware of any other county or municipality having these ordinances which are at odds with state CCW legislation, that Miami-Dade does. But given this reading of the law, any other county or municipality could conceivably pass similar ordinances and not have it pre-empted by state law. So for an updated status on this issue, check with kniferights.org and, as killgar advises, with an attorney.

Carrying a knife these days is an iffy thing at best! I will say, plain and simple, I don't recommend it. Hell, even carrying a multitool
will get you looks. Now, I have seen people on these forums give advice to people to carry discretely, to avoid attention from police
officers. Well, that may work, but what if on the off-chance a cop feels that you are up to something, and wants to search you? Then
what? It's not worth it. Overall, it's not the cops you really have to worry about, it's the people whom see a knife and become scared
and then proceed to call the cops, that you need to worry about. That's the problem in itself--someone seeing a knife and calling the
cops, which results in a public disturbance.

I will absolutely not ever recommend anyone carry a knife. But I will say this, as other members have pointed out, never ever--not
at work, out in town/city/neighborhood, to anyone, and especially and MOST of all NEVER on the internet wether it be facebook, a
forum, a board, or what have you--claim to carry a knife for self-defense. That will get you in very hot water, very fast. A knife is
typically one of the most, if not the most, ineffective means for self-defense as it is all to easy for it to be implicated against you or
turned against you. Self-defense training, a martial-art, intense physical exercise, or even a combination of two is by far a more
effective and safe means.
 
So, what about 6 inch fixed blades being kept in your vehicle in Florida? I consider it an emergency tool, but do they?

So in other words, you cant carry an assisted foldable 4" or less in your pocket!? Whether you have a CCW or not!?
 
In FL, if you have your CCW, you can carry any knife as long as it's concealed.
 
As I wrote before, a CCW in Florida preempts local ordinances by city or county restricting guns. This preemption however does not extend to knives. A gap in the preemption legislation is responsible for this issue. The only county of which I'm aware that has explicit ordinance(s) restricting the concealed carrying of knives regardless of CCW is Miami-Dade. For specific terms search your county's local legislation as suggested I my earlier post. I am not a lawyer nor do I play one on tv.

Wow, this thread has made me wonder why I am buying all these knives! I live in FL (not Miami-Dade) so now it seems edc of knife is not a good idea? Guess my budget will go back to firearms since my CCWP allows me that privilege.

It's a Concealed Carry Weapons permit. Not just a firearms permit.
 
I worked for years in Florida within the legal system in non certified positions. First the knife laws are vague for a reason, also if a weapon is specifically designed for utility or is specifically designed to be non lethal the law is a little bit more lenient. I am a Karambit fan also and have asked about them, I didn't talk to any officer that would buy the utility idea of a Karambit. The law in Florida will let you carry anything but the use of the use of the tool would make a difference. In other words as long as the knife was NOT concealed, as in open carry, then you could carry a sword, not a good idea but you could as long as you open carry. From the way I understand the the way the law is written if the tool was not specifically designed to be a lethal weapon then you can carry any way. The best thing to do the way I have been taught, is to carry a folder clipped to your pocket. I carry a full size tac folder that could be used for utility or self defense. I have seen several people open carrying a small sheath knife. I also carry a couple non lethal weapons on me. Non lethal as long as I don't strike to the head. A knife is a lethal weapon in Florida so it wouldn't matter how you used it it's going to bad news for you, just like a gun, even if you shoot the bad guy in the leg they are going to come down hard. Also the CCW law in any state that has them are nothing more than a registration scam so think hard before you get one. I hoped I made sense and helped. Carry something normal, not exotic like a Karambit. I love "em but,,,,,,
 
What they told me when I took the class is that the CCW permit entitles you to carry a concealed handgun and no other weapons. Meaning no blackjacks, stabby knives, etc. Normal pocket knives are obviously a gray area. But don't go CCWing a fixed blade karambit and expandable baton along with your firearm. I'm just going off what I learned at the CCW class at this point, I don't feel like googling the relevant statutes.
 
I got this from Florida Carry;

(a) Concealed dangerous weapons. It shall be unlawful for any person to wear under his clothes, or concealed about his person, or to display in a threatening manner any dangerous or deadly weapon including, but not by way of limitation, any pistol, revolver, slingshot, cross-knuckles or knuckles of lead, brass or other metal, or any bowie knife, razor, dirk, dagger, or any knife resembling a bowie knife, or any other dangerous or deadly weapon, except as hereinafter provided.

(b) Switch blades. It shall be unlawful for any person to sell, offer to sell, display, use, possess or carry any knife or knives having the appearance of a pocket knife, the blade or blades of which can be opened by a flick of a button, pressure on the handle, or other mechanical contrivance. Any such knife is hereby declared to be a dangerous or deadly weapon, within the meaning of subsection (a) and shall be subject to forfeiture to the County as provided by subsection (c).

...

(e) Penalty. Every person who is convicted for a violation of subsection (a) shall for first conviction thereof be punished by imprisonment for not less than six (6) months and by a fine of not less than one thousand dollars ($1,000.00); for a second or subsequent conviction of a violation of subsection (a) such person shall be punished by imprisonment for not less than one (1) year and by a fine of not less than one thousand dollars ($1,000.00).

Get the spyderco or emmerson karambit. They are both waved and are amazing blades. Little pricy but totally worth it.
