The seller certainly has the right to sell to whomever he chooses.
Usually "I will take it" trumps "I am interested"!

The seller might be new here, but I would've thought a clear "I'll take it" overrides all other enquiries, mights, ifs or needs. Otherwise a thread might go on for days waiting for extra info, questions etc. If I say I'll take it and nobody has said it before me, then I'd expect to be owner as soon as it's paid for...
 
The first "I'll take it" is in effect if the seller says it is. Otherwise it's considered proper to give the first person to express real interest, waiting only on a picture, as in this thread, an opportunity to see the picture. You'll see many threads where this occurs, where someone says they'll take it if the first party turns it down. All one asks is a reasonable time to see the pictures, say half an hour at most. There's a certain etiquette that should be, and usually is, observed on the forums just as it is in a face to face situation.
 
And most important - nobody questions the seller's decision. His goods, his rules. He can sell to anyone he wants - be it first, second, explicit, implicit, whatever. I typically wait on the first person who expresses interest and the move on. I also give 24 hrs. before moving on to the next. Keeps it fair. This is enjoyment and a hobby, than a strict business (else we'd be posting in dealers section) :-)
