GENERAL question on responsibility

If a guy buys some knives from someone. 3 of them are advertised as new or like new. 1 of them is used.

The seller drops the box of at fedex, and fedex doesn't put any packing material in teh box.

The knives fall out of their boxes in shipping. Bang all around each other, and have lots of dings and scrapes in them now.

SHould the buyer be upset? Is the seller responsible?

Assume these are 100% facts. I know there are 2 sides to every story.
 
In my opinion, it’s the seller responsibility to ship the knives in a manner that will ensure they arrive in the same condition as advertised. Odd things can certainly happen but if you’re the seller, you try your best to limit any potential problems by carefully packaging the knives, especially if they are in new or like new condition. If they were not securely and protectively wrapped up by the seller, then it’s the seller’s fault. You cannot and should not rely on someone at FedEx to do this for you.

Yes, buyer should be upset and seller should accept a return or work out a partial refund if the buyer is up for it.

Yup - seller packs, unless I knew the folks at any shipper I would not trust the packing unless I was watching.
 
Well this guy doesn't think he did anything wrong. Doesn't want to take the knives back. Says "i'll be getting screwed if I have to take back damaged knives". But doesn't
think that I"m getting screwed by keeping the fcking damaged knives. This guy is a piece of work. Doesn't want to compromise with a partial refund.

Unbelievable.
 
Tag his user name in here. The staff will gently persuade him of the error in his ways. Either he'll make it right or he'll walk the plank.

So the knives arrived like the first 2 pictures. No packaging, knives loose, bouncing around the box. He doesn't believe it's possible that the knives could have come out of their original boxes.
He put 2 knives in each box for the total of 4 knives. They aren't beat to shit, but they aren't new at all, and have a bunch of dings.

The microtech won't even fire. It goes half way. I did NOT call him a liar or accuse him, but seriously, it was perfect and now with 100 attempts, I can' t get it to deploy?

No he's handling it like a 10 year old. Completely oblivious. I honestly can't believe there is a single person on the planet earth that is typing the things he is go me in pms. Lacking any kind of accountability.

I sold over $1000 in knives, plus a freebie for $600. In my possession, great shape. Packaged accordingly and sent out as requested.
 
Here is a quote he sent me this morning when he tracked the package and told me it showed as arrived ( I wasn't expecting it until tomorrow , so I wasn't watching tracking).

"Very good! Don’t be alarmed there is two boxes the microtech and benchmade. To each have two knives in the boxes as to not have floating around but not against one another to cause any sort of scratches. Fedex said they would add packing peanuts but I left it as is just in case."

I showed pics of his "packing".
 
AND BOTTOM LINE TO ANY SANE PERSON IN THE WORLD. I paid for what you advertised. I received something WAY DIFFERENT THAN YOU ADVERTISED. He doesn't want to take responsibility. I offered to pay for
shipping both ways. I'd eat the shipping.

Guess I'll go get the quote, but ....to which he replied, then I'd be getting screwed. Completely oblivious.
