No, it's because no one has been serious about challenging it. Which is why most of the farcical trademarks and patents that really never should have been awarded stand for as long as they do. Most smaller companies who would be affected by such things don't have the money to initiate and persevere through a long legal battle. That's why the process fundamentally sucks from the start. Things like this shouldn't cost a fortune. IMO it would be far better if litigants could just sit down with a judge and straighten it out, with the judge able to call on any independent experts necessary to help him or her understand the finer points. But of course that would make too much sense and cut all the profits out for the scum-sucking lawyers.

LOL, you may be right.
Jerry might even agree with you.
But the system is what it is, you can either fight it or use it to help your biz. Personally, I think it is a brilliant move to have a trademark that isn't a maker's stamp that identifies a knife as a certain maker's and I order my Busse's sterile mostly, specifically because I prefer a clean look without the maker's mark on the blade. Even without, it still has the trademark Busse Talon Hole, which cannot be removed without literally cutting off the front guard or more.
