Who gets to decide this???

They should have just left out all of the other definitions of violations and just kept this as their only one. It's got all the bases covered.

Thats actually not as bad as it sounds. I think it is actually a pretty good law.

It does not matter if they think it is a "dangerous knife" They will have to prove that you carried the knife with the intent of using it unlawfully against another.

Unless you have just commited, or will be commitng a crime you should be fine.

This just got me thinking. So, are double edged knives "legal" in NY? They are listed only under the section that has the, "intent to use the same unlawfully against another." clause.

I've addressed this topic on the forums before - a double-edged blade under 4" should be legal in New York so long as it is not used in the commission of a crime.
 
Perhaps... but you' ll be explaining to a judge rather than the arresting PO. State Penal Law is in the process of being revised. According to Looselaw Publications, their copies are due to be out in December. All interested parties should obtain a copy. Know your laws.

Then their are also NYC Administrative Codes as well which applys directly to the 5 boroughs. More rules...

Their publications are one of only few that are used in law proceedings. One other relevant publication is "Criminal Procedure Law". It is much better to get the combo edition of "Penal Law/ Criminal Procedure Law". As for NYC, look for "Law Extracts of NYC Administrative Code/ Health Code and Charter". Another relevant publication is "Firearms and Weapons Law- Gun Control In NYC". Personal computer discs are available as well.

All bound editions are automatically updated from year to year via hardcopy mailing for a modest cost. I am told that an update for the CPL and Penal is due in December and that if current copies are purchased now, there would be no charge for their updates.

These are must have copies for those who carry weapons and are concerned with its legalities.
