Infringement?

Looks like a SHBA to me. Craftsmanship on the steel is nice, but the handle isn't quite up to par.

Not the first copy I've seen over seas, it seems they think that US trademarks don't apply to them. Best guess.
 
Looks to me like somethng made by some guy for his own use. Perhaps technically infringing the trademark on the talon hole, but if it's not a commercially marketed product, who cares?

If someone just stated, something along the lines of loving the design and wanting to make their own knife, I could respect it......but to make it sound like it was "their" own design shows no class.

I don't think his other design are infringing anything, however this one obviously is. I swear between the Chinese and the Italians nothing is safe !!@#
 
One of his other models also has a Talon hole... which is a trademark of Busse Combat regardless of what the knife looks like.
 
Right forgot that one, so two models infringe and one looks like a copy. I can see someone not knowing about the talon hole, but obviously isn't the case here.

I don't know about infringing, but I see designs stolen from ESEE, Anza, Perrin, and another Busse copy sans hole.
 
The problem is that he is in Italy. There isn't much that can be done about it.

As far as I can tell, the Italians do not recognize patents or copyright. While I am sure that there are many honest Italian companies,
it seems that they consider anything in the gun and knife business fair game. They copy everything. (I speak from experience)

Was really only addressing the Busse copies. I wonder if hes not just stripping the finish and changing the scales on the ESEE look a likes.

What I do know is that I buy Busse & Kin for more than the looks (which I do love) but its the steel and the heat treat that I think sets Busse apart.

Trademark infringement would be if he copied a logo or name, which he did not.

What he's in danger of is either Copyright, or likely (if Busse has it registered) Design or Utility Patent infringement. (the Talon Hole use and positioning).

There are pretty strict distinctions between Trademarks, Copyrights, and Patents. And it gets pretty messy with Patents, since there are two main kinds, Design and Utility, the former being more open to interpretation.

Again, please don't confuse Trademark with Design Patent. Willows did not stamp or print a logo with the image of a Busse looking knife with the talon hole. Trademark refers to a mark, which is usually a printed logo or displayed image, like on a website. The physical look of a design of a product is covered under a Design Patent. And could also be covered under a Utility Patent. But that is only IF they have been applied for and approved (which take forever).

Granted, I'm not saying it's nice of Willow to blatantly copy Busse knife designs. If Busse has the Patent, they can and will go after him. But just want to make sure people are barking up the right tree as far as legal jargon is concerned.

a U.S. federal trademark registration was filed for the above pictured logo by Busse Knife Co., Wauseon, OH 43567.
Mark Description: The mark consists of a hole in the rearward portion of the blade.

The talon hole is a registered trademark. Its not simply a design patent.
 
hey jerry i'm having trouble with my Talon hole. i can't seem to get seven loop's of para cord through the Talon hole. shhould i send it back for a knurling?
