Is Buck Tempest legal in Massachusetts

Someone said that there is now case law that counts this knife as "opening from the handle" and therefore a switchblade. I can't seem to find proof of same anywhere. Please help,

Wal-Mart stores here in Massachusetts are selling AOs over the counter. I guess that would make them legal to purchase and own. Some Massachusetts cities and towns do have local ordinances against knife carry, however.
