Hmmm ... was the package you received shipped via regular mail or courier? I'm asking, because as far as Customs goes, regular mail is slightly safer, because a mailed package pretty much has to be ticking or radioactive for there to be legal grounds for it to be opened, though they can be x-rayed (whether it contains materials sensitive to the radiation that involves or not, hence, Josh's creative packaging inclusions). Couriered packages do not have the same legal privacy protections, for some foolish reason or another. So, I guess my point here is, for future reference, ask nicely if it is possible to ship your order via regular mail. (I've also found that it's a couple of days faster than UPS, and no brokerage fees)
Also, I'm wondering about what will happen to your future orders. One shipment of naughty sharpies has been discovered & confiscated. Since they never got to you, you can't be charged for posession of a prohibited weapon, but, it is possible that your name has been "flagged" for future reference - meaning it is possible that any or all packages shipped to you from the U.S. will now be X-rayed or examined (opened) when passing through customs. What's worse is that the sender ("PVK") may have been flagged as well. Most people don't know this, but
all registered handgun owners (except active LEO's) in Canada are "flagged" like this - it also involves getting pulled over for a "secondary search"
every time you cross the border from the U.S. back into Canada.
As for what you could do about this shipment ... I don't know. It may be that 'Zilla will be able to retrieve the order from Customs, since the package was undeliverable, and retry, or offer store credit or something, but I wouldn't cross my fingers there. Best bet, I think, is to email Josh and ask him what, if anything, he/his customers have been able to do about this kind of situation.
Having said that, once Customs gets their hands on something naughty, it's pretty much theirs, whether they found it playing by the rules or not.
Sorry to be the bearer of pretty bad news.
