Legal Action?

Fellas,
I hope this is the appropriate forum to post this topic. Moderator, If not, please remove the thread as opposed to moving elsewhere. Several months ago I contacted a maker (currently a Hall of Shamer) about a knife of his I acquired from him directly at a custom knife show. Long story short, he agreed to take the knife back and honor his warranty. He received the knife three months ago and contacted me quickly to say he would take care of it. The first few weeks communication was excellent. I let time pass (month), emailed for an update..nothing, wait more (month).....email...nothing.

Due to this individual's reputation, I'm a bit suspicious that I may never see my knife again. Supposedly the blade had been forged months ago. My question is, how long would you wait until you filed a claim in small claims court? I mailed the knife return signature, insured and have kept those receipts.

What I intend to do is place a call one last time as I would prefer to give this person the benefit of doubt. If he doesn't respond, I intend to send a certified letter demanding that a replacement knife that was agreed upon, or my original knife be returned within 30 days of receipt. Furthermore, that he also respond to my letter within ten days of receipt or I will proceed with a claim in small claims court and investigate mail fraud charges. Am I too impatient? When do you decide enough is enough?

Lastly, has anyone successfully taken legal action against someone that shafted them on a deal?

Only you can decide it's time or not.

That being said some wait longer, but if this person is a hall of shamer getting your money back will probably be iffy as is.
