Liability of keeping a Hawk or "whoopin stick" in your truck.

I have always kept an "ass whoopin" stick in my truck. Should situation arise, I know that legal problems might surface. Most state and local laws vary, and are sketchy at best. That being said, in the last 10 years, my "ass whoopin" stick has become my "Aligator Gar" stick. An item which is totally legal in the south.


With regards to Hawks, does anyone have any ideas as to the legal aspect of keeping one of these in your truck? I imagine that it would be construed as a hatchet, nothing more.
However, should you need it to hack "Zombies" what kind of legal issues would one face?
Even more, I have my CCW licence, how would a judge/jury look at a situation where I opted for a more primative, and possibly more brutal form of defense?
Most laws say you either need lethal force, or you do not, no middle ground.

However, a lot of times, you grab the closest thing to you, which might be the stick or the Hawk. When SHTF, you work with what you got.

This is my "Gar stick"
Its the center of an Oak log. I was splitting wood about 20 years ago and I hit one piece in such a way that this section just kind of fell out of the center. I sanded it a little and wrapped the handle (as best I could when I was 9yrs old) I have since Paracorded the haft.

I keep my hawk in my trunk with a pack and a sleeping bag. "Planning on going packing and hiking ossifer."
 
Since I live in California (very liberal here)... I carry a 4-cell MagLite flashlight in my door panel... I used to carry my CS Vietnam Tomahawk there...
 
My guess is that it might help if it didn't look like it was meant to crack open heads. A new handle with the label and price tag still on would do the job. Other stuff is similarly disguised in plain sight, shovel, big MagLite, etc.

It is probably best if it looks 'general purpose' or 'multi-purpose'...
Especially if it is within reach of the driver...
 
I would like to disagree with keeping it new, labels intact etc. This could arouse questions about why you have a brand new tool with you.

If it looks dinged up and used it has a legitimate use flair on it, because it send the message that it has been used for another purpose then just self defense.

Having an object in your car without another possible purpose then self defense could raise questions about why you have them on you.
 
The Cold Steel shovel is one of the best vehicular attitude adjusters I've found yet, keep one in my truck always. Tough little bugger, I even use it as a shovel from time to time.

Blue Sky... I think the shovel could be a good idea if you live where one is occasionally necessary... for me, it would look suspicious, since I live in an area of no dirt roads, etc...
 
Get it a little dirty and leave it that way. You were planting petunias at mom's house, remember? ;)
 
In Connecticut, your club would most likely be considered a weapon in a MV under CT General Statute Sec. 29-38 -Weapons in vehicles., especially if you told the police you use it for "ass whoopin".

If you lived in Connecticut, and you stored the club in your trunk and didn't let anyone search your car, you would probably never have a problem. However, you would be much better off with a big old Mag-light, which has an obvious intended legal purpose (but can be used as a club in emergencies). Another suggestion would be a baseball bat, together with a ball and glove. I like the folding shovel idea, but it might very well kill someone if you hit them with it. Keeping your weapons/tools in your trunk and not allowing searches is always prudent. Whatever you decide to carry, be sure that you are justified in employing a weapon before you do so.

It is also admissible evidence that that the prupose of your gar whacking stick is not for gar whacking. Be careful what you post online or write in an e-mail. It never goes away.
 
Its good to keep a bat or suitable club in the vehicle. Yes it can be useful for more things than just self defence. I used my old baseball bat for getting the flat tire off of the brake drum, that's the main reason why I carry one. I have more than once had a stuck flat on the truck. Get the offending wheel up, and give it a real good whack on the rim as many times as required to get it off. It must be dis-similar metals and rust that causes them to seize.

So yes do carry a good bat, and make sure the spare is aired up.
 
You guys are good at this. What reason can I use for the 24 inch piece of heavy chain and the broken ax handle I keep handy in the car?

These words are true...and they are wise...it never goes away. This is why I keep my hawk in my trunk, next to my sleeping bag, my tent, and my ready pack. If my hawk was for defense it would ride in the passenger cabin with me. But, it's not... it's for chopping wood...and making camp. So I keep it in my trunk...with my camping gear...for when I go camping...in the woods...where there are bears...and snakes...and Saquatches...and other verwy scarwy stuff.

I carry a 4 D-cell Maglite and an Ace Hardware hatchet. The hatchet is well used and looks it. It helps that I often have a bundle of small branches and such in the truck bed.

"Just gathering kindling."

If it gets confiscated, I'm out $6.
 
Where I live the law is very clearly written. It says that a blade of any length is legal if it is in the car for the defense of any persons or belongings in the vehicle or the defense of the vehicle itself. I don't have a truck, I drive a ford car, but I keep a ka-bar between my seat and the center console, a hawk on the floor right behind the drivers seat in easy reach and a mini pentagon in the door....I've had a few run ins with road rage where people have gotten out of their cars and tried to fight me....I'm not a little guy so they usually back off, but on set of guys were about the same size and there were three of them, they opened the door and saw a ka-bar in my lap as i was getting up and they quickly backed off....
