Louisiana Gun Confiscation

The reluctance of the ACLU to deal with the truth is appalling. As lawyers they are supposed to know some of these more obvious details of an issue that is definitely legal in its nature.

They choose to ignore the facts.

Security, defense and protection, on a personal level, is not legally provided by the City, County, State or Federal Government. Certainly they all help to some degree, but it is not their legal obligation.

Even in prison, in a lockdown environment, people die from stabbings and beatings and riots occur on occasion. Even in a tightly controlled environment security and self defense is still a personal thing.

The ACLU has ignored that the courts have decided that each of us is responsible for our own self defense. This is a longtime legal precedent, that was legally adopted, to prevent law suits against the police department and other Government Agencies. Because this was done quietly, over time, without fanfare and falderall and NO media attention........ it was nevertheless done in complete accord with our legal system.

It is one of the legal issues unknown to the average person, the common man and only one of a few issues that has not been dealt with and adjudicated in full public view. It is scary to me that NO media attention has been allotted to this vitally important issue.

I think it is a wonderful thing that guns are potentially harmful and even dangerous, OTHERWISE…. What good would they be as a deterrent, in self defense, to stop criminal or terrorist assault? A gun that won’t inflict deadly force wouldn't be of much use for self defense.

You must wield deadly force to deter deadly force.

I too back the ACLU on many issues, but on the Second Amendment they are fooling themselves and by inaction are doing harm.

Freedom is about trust. And responsibility. And a whole lot of faith we won't blow ourselves up. But that is what the "Great Experiment" of our Democracy was- the best attempt by free men and women to stay free and self govern.

NRA ASK FEDERAL COURT TO HALT NEW ORLEANS GUN SEIZURES

BATON ROUGE, LA (Sept. 22) – The Second Amendment Foundation (SAF) and National Rifle Association (NRA) joined with individual gun owners in Louisiana Thursday morning, filing a motion in United States District Court for the Eastern District of Louisiana seeking a temporary restraining order to stop authorities in and around the City of New Orleans from seizing firearms from private citizens in the aftermath of Hurricane Katrina.

Arbitrary gun seizures, without warrant or probable cause, have been reported during the past three weeks since the Crescent City was devastated by the hurricane. In cases reported to SAF, police refused to give citizens receipts for their seized firearms. Earlier, SAF insisted that police account for all seized firearms, disclose their whereabouts, and explain how they will be returned to their rightful owners. Authorities have not responded.

Gun confiscations have been highly publicized since the New York Times quoted New Orleans Police Superintendent P. Edwin Compass III, who said, "Only law enforcement are allowed to have weapons," and ABC News quoted Deputy Police Chief Warren Riley stating, "No one will be able to be armed. We are going to take all the weapons."

For example, a San Francisco, CA camera crew from KTVU filmed one incident in which visiting California Highway Patrol officers tackled an elderly woman identified as Patricia Konie, to seize her pistol and forcibly remove her from her home. An ABC news crew accompanying an Oklahoma National Guard unit filmed another incident in which homeowners were handcuffed and disarmed, then released but without their firearms.

"We are delighted to work jointly with the NRA in an effort to bring these outrageous gun seizures to a halt," said SAF founder Alan M. Gottlieb. "Our inquiries about these confiscations were cavalierly ignored, as were our demands for a public explanation from the police and city officials about why citizens were being unlawfully disarmed, leaving them defenseless against lingering bands of looters and thugs.

"New Orleans officials left us with no recourse," Gottlieb observed. "It was bad enough that Big Easy residents were victims of the worst natural disaster in the nation's history. That they would be subsequently victimized by their own local government, taking their personal property without warrant, is unconscionable. These illegal gun seizures must be stopped, now." :)

Forget the grunts. Go after the bosses that gave the orders, starting with the Mayor and Superintendant of Police.
 
I just got back from Academy sports, I bought a few boxes of 7.62x39 to finish off the stripper clips for my SKS.

While I was checking out there was a couple from Lousiana behind me. They were looking for gas cans, they need them to get to LA and see what is left of their home. According to the Manager everyone is out of them, and Academy has a max purchase of 2 cases of shotgun ammo so that they arn't completely wiped out (hurricane in combination with Dove season IIRC).

This couple told a story that they had heard of a neighbor that stayed being arrested for looting. Their neighbor was caught with food in her hands leaving a Deli shop. That really set them off. You want to talk about people who have a passionate hatred of Law Enforcement.

The funny part was how the manager of the store replied. He told the story of people coming in all day buying firearms so that they wouldn't be the only ones going back home empty handed. Some people from Houston and surrounding areas as well as left overs from Katrina came in and bought shotguns as well as sidearms, holsters, slings, and spare ammo.

God bless them all, this is going to go on for the next few years.

Gun rights groups obtained a temporary restraining order Friday preventing police in New Orleans and a nearby parish from confiscating guns when seeking to evacuate residents.

U.S. District Judge Jay Zainey ordered the New Orleans police and St. Tammany Parish sheriff's officers to stop taking guns from law-abiding people and return any already taken.

In documents filed in federal court in Baton Rouge, La., New Orleans Mayor Ray Nagin, police Chief Eddie Compass and St. Tammany Sheriff Jack Strain deny ever ordering the confiscation of firearms.

But news reports quoted Compass as saying that only law enforcement officials would be allowed to have firearms and Deputy Chief Warren Riley as saying, "We are going to take all the weapons."

Wayne LaPierre, president of the National Rifle Association, said his group documented 30 to 40 cases of people having their weapons taken away after Katrina hit Aug. 29.

Allen Gottlieb, president of the Second Amendment Foundation, said that if residents who had their guns taken away can prove any financial losses, such as from looting, they might have a case to win compensation from the City of New Orleans.

What does Lenin, Stalin, Hilter, Mussolini, Idi Amin, Mao tse-tung, and Pol Pot have in common? When they came to power, they took all guns from the civilian population. For this reason and my strong support of individual rights, my specific goal is to encourage gun ownership.

The 10th Amendment in the "Bill of Rights," states that the Constitution gives the federal government certain powers and only those powers listed in the Constitution. Whatever power is left over is reserved to the States. Thus, the 2nd Amendment takes gun control from the federal government and the 10th Amendment puts the gun issue in the hands of the States.

Look at the 10thAmendment, it says: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

By the reasoning of common sense, it is therefore unconstitutional for the federal government to pass gun control measures, because the 2nd Amendment restricts the federal government and the 10th Amendment gives that power to the States. Thus, the State's have a right to reasonably regulate firearms, but not deny individual ownership.

They have violated the law!

Have to respectfully disagree here... Accountability for infringing on peoples civil rights has to be enforced on all levels. People in positions of authority have to know that when the winds of politics change the brownshirts who benefit from their status as part of the system will go down along with the dictator(s)...

Otherwise there is no reason for them to stand up and do what's right (or at least not do what's wrong). It's a dangerous precedent to allow those that are supposed to enforce the law to be exempt from it and to confer special privileges under the law to them. It disassociates them from the citizen's they're supposed to be protecting.

IN THE WAKE OF HURRICANE KATRINA

There has been widespread criticism of the response of US officials to Hurricane Katrina in New Orleans in 2005. The tone of these complaints is that the authorities failed to do their job quickly enough. Some commentators have said this is a racial issue, claiming that the government would have acted more promptly if the majority of victims had been white instead of black.

Others have said it was an issue of the rich against the poor, the oil companies against the consumers, the land developers and contractors seeking to force people out of the city so they can rebuild without interference at taxpayers' expense.

Democrats have said the problem is that Republicans were in control, and Republicans are indifferent to the plight of the common man.

Political slant of the truth is more like it!

Of course, I'm not a Republican anyway.... so...??? I care because this whole issue of slanted political crappola is downright crappola and that is crappola!

Anyway.... that is my view!

The gloating in the European press after Katrina hit, was downright despicable. The British Broadcasting Corporation was particularly nasty, implying the USA is a racist country led by a man who intentionally wanted to see poor people suffer. British Prime Minister Tony Blair was so incensed by this anti-American propaganda he denounced the BBC publicly.

Our friends are plain to see.
