Mixed Misrepresenting a Knife's History

How do we feel about a seller claiming to have bought a knife "brand new" when they are in fact at least the second owner and bought the knife used. I'm not sure how consequential this example is since the knife is still being sold as used, but it leaves a bad taste in my mouth.

Today I have two LNIB knives, as seen in the title. Both knives are basically new and unused, the bareknuckle has a few extremely minor scuffs on the handle, barely even visible to the eye. And the Cambria has one or two barely visible scuffs on the pocket clip. Both carried once or twice, no cuts made.

Cambria is 150 bucks, shipped

Bareknuckle is 50 bucks shipped.

1. Spyderco Delica wharncliffe. Brand new in box. Never used or carried. It is off centered. You can see in pictures. It’s not rubbing though. But has a solid lockup. No play.

2. Protech cambria with box and paperwork. Bought brand new and carried for about a week and it’s just not for me. I open some mail and boxes with It. Nothing hard. Still has the factory edge and is sharp. Few very minor scratches on handle and blade as seen in pictures. Perfect centering and lockup. Very smooth opening and closing.

In the quotes and threads above you can see where Tyler Whitt Tyler Whitt purchased a Protech Cambria listed as "LNIB", but with usage and scuffs explained and then states that he bought it brand new in his sales thread. I did confirm with the original seller that it appears to be the same knife he sold. He stated that his photos show the same number on the blade.

Again, the knife is being sold as used, so I don't know how much difference it really makes, but certainly still seems like an effort to fudge the facts in the seller's favor.

If I purchase a knife from a seller who claims it is BNIB or LNIB regardless if I’m the 2nd or 3rd or 4th owner. It’s still in the same condition so I will list it as I bought it in the exact way the seller described the condition. You are just really trying to nit pick and start issues there shouldn’t be.
 
The seller says LNIB and basically brand new, and I said brand new big whoop. Yes I could have been a little more specific, but I was in a hurry making the forum. But by no means am I purposely trying to misrepresent or scam someone.

Why not state that you bought it used? The original seller clearly stated that it had been used some and that there were scuffs on the clip before it ended up in your posession. Why misrepresent it?

I only noticed because you beat me to the original sale. Seemed odd to see you stating that you bought it brand new when I remembered the sale as used. (Obviously there's misuse of BNIB in the original thread as well, but he did clearly state use and scuffs.)
 
Bnib gets used way to leniently on this forum. It's not brand new unless you are buying from a dealer. It may be in perfect condition while being the second owner, but that's just the way of the world. Nothing is brand new if someone bought it before you.

Well, that's why I posted the thread for discussion. Tyler Whitt Tyler Whitt isn't misrepresenting it as BNIB. He's clearly stating that it's in used condition now. He did state that he bought it "brand new", which I would assume makes him the first owner. He's not though and it wasn't new when he bought it. Probably inconsequential, but strikes me as a bit offputting.

Well that makes perfectly good sense. I didn’t know that. I thought it was still BNIB if it had never been used or carried period even if bought second or third hand.

But realize this doesn’t really matter as I am selling it as used so why does it matter? If I bought it new, used or found it on the ground I’m still selling as used.

And goes on to state that he used it some and had scuffs on the pocket clip... If he had described it as blue and gold would you have repeated that too?

Well I’m still apparently learning all the lingo and I always through if I bought a knife from someone on here who says they bought it brand new never used then I could still say I bought it brand new never used. I guess I can’t.
