You might want to post on rec.guns too.

I'm not sure if you can sue mail-order dealers in your local small claims court -- it won't hurt to ask at your local courthouse.

I would still talk to a good lawyer, there may be a way he can work the attorney fees into part of the Lawsuit. Besides consultations are normally free with good quality law firms.

Don't giveup, get this guy and make him pay...

Contact your local ATF office and tell give them the guy's info, including his FFL number.

If you paid by US Postal MO, it is a Federal felony if he cashed the MO and sent nothing in return, so you can also contact the Postal Inspectors office.

Neither of these Gov't. agencies play games, and both are very willing to not only help, but to prosecute offenders.

If you want to sue in small claims court then you need to bring the suit in a court in the defendants local area. I do this roughly once per month. Each month I go after the most blatant credit card fraud of the prior month. I bring the suit in the fraud's home city in small claims court and then travel there to represent my company. Obviously it is a money losing financial proposition but I do it for the principle of the thing. I have won a judgement 100% of the time. Sometimes I get paid, sometimes the fraud goes to jail and I don't get paid. That's sort of how it works. If you want to do it on principle, then I encourage you to do so. It isn't hard. Almost all small claims courts accept suits from out of staters. If you expect to recoup your loss, then I'd recommend against it. It normally costs more than you sue for. Good luck. Well, this forum is to warn folks about others who will try and screw you. You are NOT doing any favors by not posting this guys forum name. Please post his forum name so that we will know in the future to avoid even the beginnings of any dealings with this guy.

He has stolen your money on a gun deal. He avoids you. If your version is accurate, then he is a crook. I hope you come out of this ok as I suspect that like most of us, 500 dollars is an awful lot of money.
