If it's sharp enough to use, I'd use it and sharpen it when needed. If it's not sharp enough to use, I'd think about sending it back to Case, but then I'm lazy, I'd probably let it sit and then sharpen it myself...
It's a new knife and priced accordingly, not a flea market special. I'd send it back and politely request a replacement. Yes, you could sharpen it, but would need to spend a lot of time, and remove a lot of steel. Why should you? I'm thinking Case would want to make the customer happy.
I've owned dozens of Case knives and never had one that bad. I'd call the dealer and see if they would exchange it, and failing that, send it back to Case.
