Although it's an awesome knife if it is not what you expected I would send her back.

If you traded for it with someone here on the forums you should have your standard inspection period so it shouldn't be a problem.

You said you have a 3.4 incher on the way, right? If thats the case I say trade it or sell it to another member who would want it. No sense of having 2 nearly identical knives if you can only legally carry one. Similarly, why send it back when someone else can enjoy it for a fair price?
 
That's probably what I'll wind up doing.

I'm just bummed I traded an AWESOME knife with a 3.75" blade (which is too big here in Colorado) for another cool knife with a 3 5/8" blade which is STILL too big here in Colorado. So the TnT does me no good.

3 5/8" is a LOT closer to 3.5" than 3.75" is, but it's still technically over.

What I have is a big, scary, illegal, knife. That just can't be a "good thing" (tm).

I was hoping it would be max 3.5" based on the most agressive method of measuring. No such luck.

Any of the options seems OK... That blade (the cutting edge at least) looks like 3.5" to me, but you never know how an LEO is going to react to things, even if it is technically at or under the limit. I've never had a problem with this same kind of thing in Calif. If I'm going to a protest march or something where I might get arrested, then I carry a smaller (and much cheaper) knife anyway.
 
Go to you're local cop shop (and State Trooper barracks - or whatever they're called in CO.) and ask them what the CO. law states and what they're considerations/opinions are.

Based on what you discover ~ make a decision.
 
and some cops I knew said they measured from the hilt.

I had many knives that were 4". unless you are really dumb or tremendous bad luck or are a real a$$hole. you are not gonna have a problem.

dumb: officer pulls you over for a ticket you complain and ask him to hold your knife while you get your wallet.

bad luck: someone starts an argument with you and you take part in escalation and cut him law suit insues and the fact that your blade is over the limit makes you lose the case. some dgree of stupidty here as well.


a$$hole: cop pulls you over and you call him a f***king idiot and keep on going then you have a deadly weapon on you after he busts your nutz!

Michael, you seem to really like this TnT hawkbill. It also seems that your only real problem with it is the minute possibility that one day you are going to encounter an LEO and further, somehow get busted for possession of a dangerous weapon.

I think fishface5 pointed it out in the other thread - most, if not all, of the case law I've seen in the states that I've researched deals with things like (a) someone brought a knife to school, and raised as their defense that the knife was not a deadly weapon under the definition provided by the statutes, or (b) a person, while engaged in a criminal act, used or was caught with a knife and was trying to beat the deadly weapon charge by claiming the again that the knife was not a deadly weapon under the definition provided. The point is that you are a lawful citizen, not going to bring your knife to a courthouse, airport, federal building, etc. and therefore, this is not likely ever going to be an issue for you.

Now if you were carrying a Rekat Sifu, well then... :D ;) :D But don't sweat this one dude!

My opinion is that we are facing the very real prospect that one day in the future we will not be able to legally carry sharp tools of any kind. So for now, carry what you want, within reason, and be smart about it! That TnT hawkbill looks very nice - carry it!

Here's my dilemma. I had a Boguszewski Cobra. Advertised length of 3.75", but it didn't "seem" that big, if that makes sense. Looks like a gents folder. Awesome knife. Coolest knife I've ever seen. Loved it. But it's illegal, so I traded it for this TnT, which I was ASSURED was slightly less than 3.5".

I figured OK, trade a VERY cool illegal knife for a PRETTY cool legal one. Sounds reasonable.

But now I have this big, scary, threatoning hawkbill, that isn't as cool as the Cobra, and it's not legal either.

If I'm gonna carry an illegal knife, I'd rather it be the Cobra.

It's been said "the TNT is less illegal" -- isn't that sorta like being "almost pregnant"?? It either is or it isn't.

If you got that knife from someone else here on the forums, then (s)he should be willing to take it back if not too much time has expired AND you did not finalize the deal already. If both of those are true, and he doesn't take it back, then it sounds like you have a good case for GB&U...

Regarding the "less illegal" comment, I don't think the TnT is "less illegal", simply "borderline". I.e., it could go either way, depending on who you run into. But I still stand by my original statement that you are not likely to have a run-in over this, and that if you do, you will likely get a little slack if you demonstrate your honest intention to stay within the confines of the law.

It didn't work for me, and Underdogizhere refused to take it back.

Worked out a deal with Tom. Those of you going to the Las Vegas show might see it.

i have not told you NO mike..heck, i haven't even gotten the cobra yet to send it back..even though we agreed to ship express..you have had the mayo for 2 days now and i still have no cobra..so, before judgement is passed on the way i handled this particular deal please, everyone review the facts and what was agreed upon....

Sounds like we're on track. What happens if I (for some reason) I don't like the TnT? Can I express it back to you, no hard feelings? I just picked out a box for the Cobra. Sure hate to part with that one. What's your bottom dollar on the TnT? Maybe I can just scrape up some cash.

mike, i need to know if you really want it..because, i am losing out on two other trades to take yours...and like all forumites, i will adhere to their policy.. if the TNT is defective in anyway i will take it back but, i do not think it is fair to either of us to trade knives..keep it a day or two and trade back..because it does not feel right or something better comes along..it is right at 3.5 inches long maybe a hair under so, you should be fine..it ties up too much time and we both lose $$..

Just so we're clear. I want the TnT. Now it's just a matter of of the Cobra or maybe something else or just plain cash. But I want it. I really think I could use that. Frankly 100% of my knife usage is opening stuff (usually boxes that have other knives in them!) and that parrot bill looks perfect for that.

any way, i can go on and on and add more e-mails..but,i think it is clear that i stated my position up front on this trade..i felt all along he was a little uneasy about parting with the cobra..but, he insisted so, I CLEARLY STATED THE CONDITIONS OF THE DEAL because i was missing out on two other trades and he was TOTALLY agreeable..and nothing personal, but 2 makers have e-mailed me stating that it looks like its not the blade that is the REAL issue (BOTH POLLS AGREE WITH ME on the length and that he should keep it), but, actually he doesn't like the knife..and in e-mails to me he keeps talking about the handle being too damn (in his own words) big..and he has already made a deal with mayo and expressed the hawbill to him but, i haven't even gotten the cobra yet?
any thoughts on that FIREBAT?


NO HARD FEELINGS..I just thought some facts should be made known, since it was stated i refused to do anything..
 
I'll have to dig up the e-mails, so I'm paraphrasing, not directly quoting.

He did ask me to express mail the Cobra. I missed that part in the original e-mail, but it's there. My fault totally.

In at least three separate e-mails, he's stated "a deal is a deal", and "unless it's defective, I won't take it back -- and it's not defective".

I'm not sure how to characterize that except as "refused".

I'm picky when it comes to knives. Especially $500+ knives. I worked quite litterally 24/7 for a week to come up with the "extra" money to buy the Cobra. And it's an absolutely AWESOME knife.

The blade on the TnT may-or-may-not be over 3.5". Lets leave it at that. But -- and this is important -- the 4.75" handle coupled with it makes for a GREAT BIG SCARY NASTY looking 8.25" overall package. And even that's OK in some locales. But when you couple a MAY-OR-MAY-NOT be 3.5" blade with big, scary, nasty, you're looking for trouble.

I was fine with big, scary, nasty as long as I was ASSURED (and I was) it was _technically_ legal. Having the knife actually in my hands, I'm not at all convinced it's legal.

Well, Tom will have it on Sunday. One thing I learned from Underdogizhere is that Express only costs $2.00 more than Priority. Sorry I was a little slow on that.

I sure hope he likes that Cobra when it arrives (I screwed up and sent it Priority), because I'm pretty much SCREWED if he wants his TnT back.

It sounds like in the end this all worked out. Michael, I hope that whatever you are getting from Tom will be more what you like in a knife. What are you getting by the way?

Underdogishere has a great reputation on this forum and it does sound like he stated before hand that the only way that he would cancel the trade was if there was something wrong with either knife. It sounds like he put that stipulation on himself as well.

Anyhow, I don't want to turn this into a GB&U thread. I just hope everyone ends up satisfied in the end.
