I live in central NY and because of the Camillus Cuttlery closeing, I have found a soft spot in my heart for thier Pilots knifes. The last 1 1/2 or 2" of the clip blade ( I think that is the correct term, for the top edge that curves up at the end :o ) is sharp. I hope that my state laws don't require defaceing that part of the blade just so I can carry that knife in the woods for hikeing , hunting , and a general purpose survival knife. I tried the links above and got a headache . They are fixed blades , 5 - 5 1/8 " .
Any advice ??

Phil

Do what it takes to find and buy yourself a Pilot's Survival Knife, just don't tell the bastards in charge up there that you have it. :D

No size limit In NYS ( only NYC).......carrying it while hiking, hunting, fishing should be fine

Thanks guys :)
I was worried about the sharpened clip , I've heard that some places call that a double edge , making it illeagle. Looks like I'm good to go then

If the clip is actually sharpened, that is, enough to cut, it probably does count as a double edge. My Pilot's Survival has a clip that I could put a cutting edge on easily enough, and it would be useful, but it isn't actually a double edge as is.

Out in the woods, I can't believe anybody would go around inspecting how sharp a survival knife's clip is. :) That Pilot's Survival Knife is like a stockman or a Swiss Army Knife: it's a traditional and accepted standard user knife.

Thanks, I was not too worried , mostly currious.

I live in on Long Island and I carry a Sog Seal Pup (Fixed Blade) mostly every day. The blade is about 5". I think it is legal to carry.

1894. I don't see this resource listed: http://pweb.netcom.com/~brlevine/sta-law.htm . It looks to me like your sharpened clip is probably ok, but I'm no lawyer.

I do, however, live in upstate NY and have carried and used sharpened clip knives for years and never had a problem. I do try to refrain from waving them around in public though ..:D

Thanks, Great link , I didn't even get a head ache reading it :) Couple of chuckles though ;) I love the opended wording our State uses " Dangerous Knife " Even includes an ice pick
I have no intention of diceing up my fries at the food court in carosmell Mall
with it ;) For me , If I need to mark a spot in the woods with that bright tape though , the clip is perfect for removeing it on my way back out without hurting the branches.

A friend of mine was stopped by a cop in New York City for carrying a 3 inch locking blade. He was told that all locking blades were illegal. This contradicts everything I have ever read. From my understanding, only locking blades 4 inches or larger are illegal. I had a friend of mine who is an attorney read the law, and he read it the same way I did, but said I should consult the police.

If anyone has any insights, it would be appreciated.

In the meantime, I have contacted the police department for clarification of the law. Not particularly optimistic about that approach for several reasons. I'll report back if I get any further information.

Finding out what the law is, and obeying the law, should not be this difficult.

Wexie, the NYC/NYS law has been stated several times here....look at my old posts...a quick answer is NYC UNDER 4 " blade and MUST NOT BE VISIBLE ( not even a pocket clip). NYS Penal law only bans switchblades, gravity knives, and the all inclusive "dangerous knife".....I can only assume that your friend was stopped because the officer saw his knife. If it is visible in NYC it is illegal no matter what size or locking or not....keep it in your pocket, out of sight, and keep your blade tight so it can not be flicked open if it is a locking blade...

Tom, sorry to keep discussing this point, but absent a switch blade and gravity knife, isn't a "dangerous knife" in NY State (not city) only dangerous when it is used with intent?

charlesbjr, the term dangerous knife in NYS PL is not a defined term and therefore is always an item of debate. A knife that is designed primiarliy as a weapon ( spear point, dagger or bayonet blade, finger guards, etc) can fall into this vague definition. In NY there is a general anti weapon / knife attitude in the court system, so trying to argue that this defintion is Unconstitutionally vague, is not taken as a good defense. The Penal law is a tricky read in this area, as intent is noted in the law for certain weapons, but if you read further down the law it states that simple possession implies intent.....In most cases a weapon in a house maybe excluded from this charge, but a weapon on your person will fall into the "intent" definition. Always remember that in NYS possession means control over an item so that includes anywhere it is possessed by you unless otherwise defined. The charge of possession of a illegal firearm ( hand gun) is clearly stated to be a misd if it is in your house, but a felony anywhere else. This is the only part of the NYSPL on weapons that allows for a different level of possession....this is the section that defines intent under section 265....4...
"The possession by any person of any dagger, dirk,
stiletto, dangerous knife or any other weapon, instrument,
appliance or substance designed, made or adapted for use
primarily as a weapon, is presumptive evidence of intent
to use the same unlawfully against another."

Tom19176, I know this was discussed a while back. But correct me if I am wrong, this law does not apply to hunting, fishing, camping, etc. Again, barring any switch blades, gravity knives, etc., one will not be considered to be in posession of a "dangerous knife" if involved in the aforementioned activities?

I am now a member of Knife Rights (as well as the NRA) and just hope that one day, they can also have the positive impact that the NRA has had. Lord knows, we need the support...............

charles if you are engaged in those activities you are safe in the possession of a knife ( get a fishing license) ....Until recently an officer who arrested someone on the sole charge of carrying a knife would have been laughed out of the command, and the desk Sargent would have vioded the arrest. Now it is a good deed for an officer to issue a summons to someone who has a pocket knife clip showing ....times have changed.....

two years ago on the way to a scuba trade show in New Jersey . I got informed at the border crossing into New York state that the double edged scuba knife that i had made was ,, illegal in New York state . the border guard even checked with the New York state trooper there ,,and the conclusion was its not legal .
being good guys that they were, they let me keep it since i was on my way to NJ with it but told me to keep it out of sight in NY .

Does anyone know if it is legal to carry a full size Ka-Bar fixed blade in New York as an every day carry knife?

KnifeGuy07, Not legal in NYC, but the rest of the state( except I think Yonkers has a blade limit), it is for the most part legal. NYS has NO lenght limit in the STATE PL. There maybe some county here and there that do. I would say it will depend on where in NYS you live and how the local LEOs look at it. There are three some what vague terms in the NYS PL that could be used to say that the knife is illegal. It could be a "dangerous knife, dirk, or dagger".....where do you live in NYS ?
