PA Laws

This law removes any mention of knives of any kind from the PA "Prohibited Offensive Weapons" statute as of 01/02/23. So all knives will be legal in PA, unless you are carrying it with intent to commit crimes. Watch those local ordinances though. Municipalities can have their own laws. PA prevents municipalities from enacting their own gun laws, but knives are not protected the same way.
 
Where does PA law forbid concealed fixed blades?
A few years ago, I contacted two different PSP barracks and two different PA lawyers. All four independently stated that fixed blades were illegal to carry concealed in the state of PA. Maybe they were incorrect.
 
People have spread so much misinformation with regards to knife laws not only in PA, but in other states as well.

For example, there’s a well known knife reviewer on YouTube (won’t mention his name) who I admire and respect, but he keeps insisting that balisongs are illegal to carry in PA, even though there’s case ruling that they aren’t in the same category as autos. I’ve corrected him on this dozens of times yet he keeps repeating the same incorrect info in video after video.

It’s like the myth that has persisted that fixed blade daggers are “prohibited offensive weapons” in PA even though if you look at that language it is clearly a part of the auto knife definition meaning any dagger, knife, razor or cutting instrument that opens automatically.

Kind of ranting. It just annoys me when people make up laws that don’t exist.

Anyway, I look forward to autos becoming legal on January 2 like everybody else. Merry Christmas guys!

There's some of that misinformation being spread right there. Autos have never been illegal to own in Pennsylvania, that's a common misconception, only illegal to carry. CURIO EXCEPTION has allowed the lawful ownership of Auto knives in PA, as long as they remain at home and you have a valid argument for owning it.

With that said, it's a moot point now with the new bill effective Jan 2nd.

I was aware of that. I actually meant to say legal to carry.
 
You believe kniferights over the Pennsylvania law website? Have you actually read the current Pennsylvania law?

Yes sir I have read it many times. I live in pa and was in close contact with my senator snd representative on the bill which was HB 1929. The law was to take affect 60 days from signing. It amended title 18 criminal code by removing “automatic knives” from the list of offensive weapons. The last act on the measure (act 119) was the governor signing on Nov 3, 2022

Yes you have always been able to own an automatic or assisted knife in PA as long as it was part of a “curio or theater set”. The vague language has been interpreted as meaning no personal carry. Keep them at home as part of a collection and you were fine. The new law makes them now legal to carry or posses outside your home.
 
Click on the text of the bill and page 2, line 7. States "law shall take effect in 60 days". The shaded gray language was "removed" from title 18, section 908(c) basically removing automatic knives from the prohibited offensive weapon. The 60 days can't be any more clear than that. I won't carry until Jan 3.

There's a difference between a bill and a law. I quoted the law as it is, on the books.
The law is what can be enforced. The bill states, "This act shall take effect in 60 days".
The act is in effect, and it is within 60 days. It is now the law of the land in Pennsylvania.

Come on January 2nd. I'm trying to decide between a Microtech Ultratech or Hogue Counterstrike. And a side opening Protech. One OTF and one side opener to make up for lost time lol. I'll be carrying a couple autos in 2023. Thanks again Knife Rights!
