Is it possible to claim from Paypal when an item has never turned up?

A seller claims they sent me a knife (and I do believe them)but says as I live in the EU they have no responsibility to refund non-delivery. One Barkie went for a walk it seems...but I paid with Paypal.
 
I would definitely check with Paypal. I normally take the seller side of things, but your seller is a bit of a dumbass. He should have insured the package. I've had two international shipments lost in the abyss.. both were returned within 2 weeks of submitting a USPS "trace" request (first step in submitting an international insurance claim).

Did you allow Paypay to deduct from your bank account or did you pay with a credit card thru them. If paid with credit card, I believe you can still dispute the charge and make seller prove delivery. However, Paypal usually wins out in the end.
 
I've had this sort of a problem before with some ebay items that weren't shipped. I filed a dispute with paypal and when I did that they took money from the sellers account and escrowed it until the matter was resolved. I believe that you have either 30 or 45 days from purchase to file this dispute so if it has been a while you might want to do it soon. My issues were resolved so I can't tell you what will happen if the seller won't return money or send another item. Good luck to you.
 
I believe if you check with PayPal's Resolution Dept. on the website, they do cover non-receipt of goods. How that may or may not differ for overseas delivery I don't know.

The circumstances are much different in regard to eBay items as opposed to no-eBay items when using PayPal. If it was an eBay item you purchased you are in a much better situation to make a claim and get payed back for your item.. Good Luck!
 
Not to stir the pot...but this is why I don't ship overseas...to much drama.:D

Maybe, but you are not the one out of pocket here, I the buyer am!

This was a non-e-bay item so it looks like curtains for my claim...

The original seller (bought 3 knives from them before) was asking HUGE rates to ship one knife suddenly (this was before the recent USPS price hike in mid May).
So I opted for the cheaper version and got burned. Thing is, I won't be buying anymore Barkies from this source as they cannot prove they sent me the knife, but I can prove they got the money :mad:

RIGHT!! what the hell....listen, I am sorry you lost your money..that really sucks, but I was simply stating that its to much hassle to ship overseas..with the ammount of knives that come up missing..one has to wonder..what the hell is going on in the PO's over there. I myself shipped a knife I sold on Ebay to an overseas buyer...I was new to the online buying/selling thing. The buyer claimed the knife never got there, he got his money back from Paypal, and I was out a nice knife...and Paypal charged me $10 on top of it...needless to say...I won't be doing that anymore..unless the buyer accepts full responsability for said item...that means...I am free after I ship my knife. Sorry about your loss man, really not trying to be mean spirited or cold, just stating my position. Gene
