Selling Knives...

Sorry about the title but a friend of mine is begging me to get into the "Custom Knife Business"... My questions are;
1- If you come up with a name for your knives, even if it is a general name like ACME or LONE WOLF or anything... how do you protect that name?
2- If you sell a knife and that knife ends up injuring someone or the user is injured thru breakage or failure... Can the maker be held responsible?:eek:

1 - File for trade mark.

2 - I don't think so, but then look what some lawyers are doing in regard to guns and food.
