Show off your Emersion knife!

What's this I hear about California and blade length limit? Last time I read here there is no length limit in CA.
 
i think for california for a fixed blade there is no limit as long as its not concealed BUT theres a catch to that in some counties. for example since theres no limit for a blade length in my county, i could strap a sword to the my back as long as it isnt concealed. but since theres somthin called a statute of limitation it would be illegal for me to do so. to LEGALLY conceal a folding blade it can only be 3 inches or smaller. ive talked to a few CA cops and theyve all told me that its legal to carry a concealed 3 inch folding blade anything higher is a misdeminor. but as for fixed blades im told theres no limit weather concealed or visible, but then in some counties there are statutes of limitations. the CA law is confusing!!! so i play it safe and carry my bad@ss 2.9in mini Emerson so theres no disputing!!!

Now that's concerning. I'm in San Francisco and have been carrying a 4inch Spyderco Military for the past year... Maybe I should use my Delica more. None of my Emerson knives are 3", might be time to grab that Mini 7

yea im in Hayward just across the Bay from you in Alameda Co. i dont know what youre statute of limitation is, i mean im sure its ok for you to be carrying your Spydy as long as its visible, im sure just clipping it to your pant pocket and having the handle show isnt concealed. but yea i recommend the mini 7 its OUTSTANDING!:) btw GO 49ers!
 
There seems to be a misunderstanding regarding "statute of limitations" in California. I have been a police officer in Ca for going on 28 years.

The "statute of limitations" is the time limit allowed by the State to start legal proceedings once a particular crime has been committed. It differs based on the severity of the crime.

Example:

Homicide has no "statute of limitations". It can be prosecuted at any time.

Misdemeanor cases generally are one year from the date the offense was committed.

Felony cases generally are three years from the date of the offense. There are some exceptions to this when dealing with sex crimes, elder abuse ect..

Some of the exceptions are also based on the possible sentence for the crime committed. The more time in state prison prescribed in by law, may stretch the time limit.

As for blade length, no specific length is described in the penal code, except when dealing with switch blades. Switch blade under 2 inches are legal.

or when bringing a knife onto school grounds; fixed blade under 2 1/2 inches is the limit. Folding knives with locking blades, or dirks and daggers or a razor with an unguarded blade are a no no.

Now different cities and counties may have local ordnances that deal with the size issue.

Generally a large fixed bade must not be worn concealed. Even when worn in open You may still get questioned.

This is just a quick quide. Laws are changing regarding knives so contact your local police/sheriff department for detailed info.

Hope this helps. Most cops don't go looking for people with knives, most people contacted by police carrying knives have come to the attention of the police by their own actions. Some cities have more problems than others, and to keep the peace may take action for the publics safety. But in the end the D/A has the decision to make whether or not to prosecute.

oh man i totally butchered the whole "statute of limitations" thing for CA and for that i apologize! :o but thank you for your input this actually helped a lot! quick question though, would a concealed 2.9in knife be legal to carry on ones person in CA? i live in hayward, Alameda Co. i see youre in the bay area, im sure you know where it is! thanks again for the info!
 
yes, a folder would be legal as long as it is not a dirk or dagger, which is an object with or without a handguard that is readily capable for immediate use as a stabbing instrument. It does not have to be a knife. Sharpened screwdrivers, or ice picks and other tools can qualify as a dirk or dagger.

A folding knife, carried folded in your pocket does not qualify as a concealed dirk, since when it’s folded, it’s not readily available for use as a stabbing instrument.

Something like the cold steel push knives even thought small are illegal concealed.

That Rino is damn nice but I don't think it tops your 6.

You might be right. The 6 was the first Emerson custom I ever got and is very special to me, since it took 9 years for delivery. The Rhino took 15 years for me to get. But Ernie lost my order for it back when he started offering them, so I was lucky enough to get a second chance at owning the Rhino.

I'm unfamiliar with the world of custom knife making. Is 9 years common for custom EKI's and is that regular waiting time from most custom knife makers?
 
A 9 years wait is outrageous. It doesn't take that long to get a computer, car, house, etc.
 
well it takes that long to get an emerson custom.

he didnt require deposits though, so the list got outta hand pretty quick because ya can take one of his customs and sell it on ebay for 2X what ya paid, he hasntput anyone on the list in 8 or 10 yrs now so he must be catching up, finally, if i was ernie it woulda been hard to stick with the list knowing the knives i was selling for $550 could be sold for $1100, $1200, whatever, and more than a few folks did just that as soon as they got them, i have heard of folks selling there number on his waiting list for $200 FWIW.

so, imho, ernie aint a bad guy, just a busy one what with catching up with all the folks on the list on top of running EKI and all the other stuff he does,

and like i say he didnt take a dime of anyones money prior to making the knife so really no one can gripe too much, its not ernies fault he is so popular, he always told folks about how long it was gonna be.
 
heres my new Emerson CQC-7 Mini SFS. i bought it about 3 weeks ago and its amazing! best knife ive ever owned! its thick and feels like a tank. living in CA i can legally carry a concealed blade as long as its 3 inches or smaller, the Emerson is perfect! so here it is!

To the best of my knowledge, Cali does not have law regarding the length
of concealed pocket knives.....
