Silverband: sold broken knife

I recently purchased a Sage 2 here on the exchange from the poster Silverband. The knife was sold as being an excellent user with a small chip in the blade that could be sharpened out. To his credit Dave shipped quickly, which was nice. I got it and, excited to carry my new knife, sharpened the chip out immediately.
I wish I had waited. After carrying the knife for a few hours, I realized it had a way-too-weak detent. Further examination revealed that it had severe lock slip. Got bit quite nicely figuring that one out.
I contacted Dave to let him know about the weak detent and dangerous lock slip. He was willing to take the knife back until I mentioned that I had sharpened it, saying that I had modified the knife, making it my own.
I'll cede that he almost has a point. If I purchased the knife, sharpened it, and decided "eh, not for me", then I could understand refusing to accept a return. Fair and reasonable. But he sold me a knife with a faulty and dangerous lock. Of course I sharpened the blade, who would carry a chipped blade willingly? The knife he sold me had MAJOR undisclosed issues, and Silverband jumped at the one excuse he could to avoid refunding my money. Buyer beware.

I would have given the knife a complete and through inspection and made sure it was to my satisfaction and I was going to keep it before I sharpened anything.

I don't think anyone here is trying to pull one over on the other so I hope you two can work it out.

You're absolutely right. I should have looked it over more carefully first, but assumed that because he disclosed the chipped blade there was nothing else to look for. Lesson learned.
I don't think there's anything to work out, he made it very clear that the knife is my problem now.

Not all's lost here, I'd pay the $5 and send it in to Spyderco and have them fix / correct any issues.

This is a tough one. He should have disclosed the problems if he knew about them, but you also should have inspected the knife before you permanently altered it by sharpening. Faults on both sides. I would say that you are stuck with the knife but I would ask him to cover the shipping to Spyderco so it can be fixed.
 
Did you do a nice job sharpening the knife ? If so you have actually improved the knife . I would charge him $10 bucks and make him take it back. If it was knowingly sold that way. Honestly I don't know how much a spyderco knife like that costs but wouldn't you feel better just buying new when it comes to a inexpensive production knife. Just a thought.

Yes, buying new would most likely exclude problems such as this and offer a more transparent and streamlined return policy.

However, buying used off of the Exchange can put more expensive items into the hands of a more budget minded person.
The Sage 2 for example, runs around $185 or so new. I've seen them on the Exchange as low as $125. That's enough of a difference to go from out of the question to actually attainable.

As for the OP's situation, I hope it all works out amicably.
 
I sharpened it quite nicely if I say so myself. Unfortunately short of driving to his house I've got no way of making him do anything. In the future I'm buying new. The Sage 2 is available new for $155 or so, I paid $100 to save a couple bucks for the holidays. Kinda threw that money away.
 
Well don't let one bad experience sour you on the exchange. I have had enough great experiences with really incredible members here that I always check the exchange when I'm looking to buy. Of course, there are always those few bad apples that sneak into the barrel.

You know, if you paid via Paypal you could always file a claim that the item was not as described. A last resort of course, but always an option. Did you send Silverband a link to this thread?

Or you could spend an additional $5 as others have mentioned and just have the knife brought up to spec with a trip to the Spyderco farm. I understand your frustration with the detente and lock but the situation is far from hopeless.
