SOG Sculptura is it a Gravity knife?

I really like the SOG Sculptura but I read that it can be opened by pulling back the arclock in a flicking motion, does that make it a gravity knife? If so then wouldn't it be Illegal in many places?

If you pull back the Arc lock, the knife can be flicked open (and shut). I'd hate to address the legal issues...
As far as I know the Sculptura is sold legally in every state (and Canada, I believe).
