SpyderFly/SzaboFly Recall Announcement

Wow, I noticed this on another thread. I missed this one, it appears to be dated 12-April-2007.

I apologize if there is another thread on this one, but what is the scoop? I have a Spyderfly that I purchased middle of last year.

US Customs brought to our attention that some of the parts used in the construction of the SpyderFly/SzaboFly were imported contrary to U. S. Customs laws.
Ouch!

Additionally, federal statutes require that only certain classes of individuals may purchase knives that fall within the definition of switchblade knives
How do you check if you are OK in your state, although I am 99% sure I am hosed?

If you did not qualify as an authorized dealer or purchaser at the time of acquisition of the knife(s), please return your purchase directly to Spyderco for a credit or refund.
Has anyone tried to return a knife? Is the thought that if you are in one of these "illegal" states you should return it?
 
from what i remember if you send it in to spyderco for warranty work they are bound by law to destroy it...knowing Sal i'd say he would probably give you a credit for the purchase but do you want to give up the knife? as far as local laws are concerned if you don't know keep it in the house.
 
Spyderco was required, or agreed, to tell people to return them. I doubt that many have or will. The issue was only with customs, so, unless you plan on taking it across the border, I wouldn't worry about it.
 
Umm, that recall statement is old and outdated. After a joint effort investigation with US customs, Spyderco's lawyers sent out an addendum, which basically says that even though the recall is technically still in effect, instead of taking it to a dealer, you're required by law to send it to my address. Send me an email for details of where to mail your knives :D

Update:

After further investigation, and a successful joint suit filed by the federal government and an unknown third party (patent holder) that wishes to remain anonymous, all other Spyderco knives produced on or before August 8, 2007 are now deemed unlawfully produced due to a patent infringement on a certain unidentified feature that was missed by Spyderco's patent lawyers. Spyderco has paid the fine and purchased the rights to continue using the unidentified feature in their knives, so any knives they produce after today should be considered OK. And in a double whammy ruling by the court, possession of said unlawfully produced knives is now considered illegal, and punishable by large fines and possibly time in a locked room with a hungry Roseanne Barr :foot:. Even Spyderco dealers are covered under this ruling, so you can't return the knives to them, but I was granted an exemption in order to harvest all the knives for disposal. Therefore, it is of utmost importance that you mail all your knives to me so that I can "dispose" of them in accordance with the law.

Oh yeah, and Roseanne had gastric bypass surgery, which means if you decide to disobey the ruling and end up in the locked room with her, she'll consume you in small ounce-sized servings :barf:, which will be even more painful for you. So make sure to send send send!
 
From what I understand, Customs classifies the Spyderfly as a switchblade, but other Federal agencies don't. The statute is (intentionally?) vague, and open to interpretation.
