Spyderfly + warranty q?

I have a Rainbow spyderfly that I lent to my friend. Said friend has returned the spyderfly with a very dull edge and No latch. . Now, my question is, with spyderco's current legal problems, can I return this to get sharpened and/or get the latch replaced?

Could have dropped it...or the latch was the most likely part to fail on this design IMO based on complaints...
