Strange Spyderco at Flea Market Fake?

Yeah, but Sal has tried to go after the makers, who can then scurry like rats. Evilbay, on the other hand, ain't going anywhere and they continue to facilitate copyright infringement even when they are informed it's going on. They are a 'deep pocket', are located in the USA, and have demonstrated a pattern of indifference.

I that a good lawsuit might just make them a little less complacent and might fund a nice vacation for Sal.

The problem is, does Spyderco have enough money to do legal-battle with someone like E-bay? Let me assure you, they have a team of lawyers, and they aren't fresh off the bar. E-bay has massive resources, and can drag it out for a long time and make it very costly for whoever is opposing them. In the scheme of things, Spyderco is a small production company and they have to think about where to put their money. Those are my thoughts, anyways. Pick your battles.

Makes sense. If it will cost a ton of money to stop a few sales, then maybe skip the fight.

Another option would be to target the individual seller who is truly to blame here. Ebay shouldn't allow counterfeit goods to be sold, but the sellers are the ones actually listing and selling the goods.

Maybe hire a lawyer to take it on 99% commission rather than use your in-house council? There's probably somebody out there who would do enough work to make eBay notice just on the hopes of getting nice payout at the end.
 
I reported the item and contacted the seller. I got a reply from the seller- something like: "Good to hear from the knife police again- thanks for your opinion". Obviously doesn't care that he is selling counterfeit merchandise.
