Well, it's obviously using the spyderco lum folder's design. But it may be hard for Mr. Lum to claim the design property. Cause it's a traditional South-eastern Chinese design. You can check out Joe Chen's webpage about this design at here
 
lreed: there has to be easily a thousand spydie ripoffs out there. even 95% of the gas station specials, and there how many of those floating around. Some get quite obvious, like the ying yang cricket knockoff I found about a year ago in zellars. Looking at it, the only really obvious clue was a teardrop shaped hole(like 1/2 the ying yang).

Really? I disagree.

Bob Lum, first came out with that design back in 1998, and I should know because I got one of the first first ones he ever made. And while he based that design from the traditional Chinese Shi-lin pattern, he introduced many of the specific design elements the Linton version is using; such as the handle shape, liner lock (as you know the Shi Lin was a simple slip joint folder), flat ground blade, and pivot geometry.

It's because of Bob that the knife Joe Chen showcased is gaining recognition in the US. So, while Bob never claimed to invent the design, what he did was to bring an old design up to date. Just as he first did for the tanto back in the 1970's.

Finally the process of being granted a modern design based on something old happens all the time. Les DeAsis was granted a Design Patent for the modern balisong in the 1970's, yet he did not invent the shape. So, if Bob really wanted to, he could probably have been granted a Design Patent for his version.
