There is no word association with the hole that is trademarked, thus no word association with it can be legally guarded. However, the hole itself is trademarked as a "mark".

Good info and good reading, thanks. Seems that they rejected the trademark at first because they determined it to be functional. Busse explained that it is not ment to be functional but a symbol. The tradmark was accepted, that means however any functional hole in the rear portion of the blade would not violate the trademark. Very interesting. Thanks for the link and info LVC.

If they wanted to get away from it, they might be able to move the hole up out of the guard and still be able to use a modified version of the d-guard. I think a lot of companies are willing to modify the design on request because it's easier then even considering trying their hand at a court case on it (both functionally and monetarily.) The addition of a d-guard makes most of the zombie tools models a lot cooler looking, and I hope the best for them. I'd love to see them figure out a way to maintain the functionality in one way or another.
 
that steel would melt like butter once exposed to a little zombie blood which is as corrosive as alien blood. Jerry invented INFI so that we would be able to avoid dealing with such weapon failures.

Not entirely correct. If the hole can be moved up and out of the guard area and still maintain the functionality of the accessory, then the trademark stands. In the case of a removable d-guard, it can be moved without losing functionality. :thumbup:

Just spoke with Chris from ZT and he was unaware of our trademark. He has agreed to move it or remove it. Great guy!
