Calif. lawyer sues Yahoo over message-board posts

A California lawyer who has waged an ongoing battle with Yahoo Inc. over personal attacks made against him on Yahoo message boards has filed a proposed class-action lawsuit against the company.

The suit, filed in Los Angeles Superior Court on Wednesday by associates of corporate attorney Stephen Galton, claims Yahoo has unfairly protected people who post negative messages on its bulletin boards and falsely advertised that it prevents such abusive messages.

"It wouldn't be prudent for us to comment on this pending lawsuit," Yahoo spokeswoman Mary Osako said in a statement.

Galton is a partner in the firm of Galton & Helm, which specializes in insurance law. He registered to use Yahoo message boards in early 2004 in order to respond to a negative late-2003 post about one of his clients, which he did not identify in the suit.

After Galton posted his response, under the screen name "stephengalton," he was subjected to name-calling by various other users of the message boards.

One user, a person using the screen name "mumioler" who had posted the original messages about Galton's client that started the dispute, wrote a series of new messages calling Galton a "shyster" and an "overly robust geezer that makes a living walking behind the elephant with a shovel."

Other users also took personal shots at Galton, and he filed suit in April of this year against them. At the same time, he sought their personal information via a subpoena from Yahoo. The company, the suit said, responded with incomplete or inaccurate information.

The suit proposes as a class any California resident who has been targeted by abusive messages on a Yahoo board, who tried to get such messages stopped or learn the identity of the message poster, and who had such requests denied within the last four years. It seeks restitution, a permanent injunction and other forms of relief.
Am I reading this right? He wants Yahoo to stop people from saying bad things about him online? Ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha

This would set a precedend that would signal an end to all message boards and forum sites - maybe the conspiricy theorist might want to play on this one.
 
Naaahhh ... I'm no shyster ... I never even worked in a legal department! And I don't make a living doing anything, I'm retired :) On the charge of being an overly robust geezer, I withhold comment, on the grounds that a direct answer might tend to incriminate me :grumpy:

Can you imagine anyone so smart that they actually got through law school could be so stupid as to miss out on the meaning of The First Amendment? I bet even you know the meaning of The First Amendment and you're a furriner!

I can understand and might even agree, if he were treated shabbily in a publication of some standing, it could negatively impact his reputation, but ... the internet? Is he an idiot, or what? Maybe business was just slow, and he figured they might pay him a few bucks to go away ...
 
Exceptions established by the courts to the First Amendment protections include the following:
(1) Defamation: Defamation consists of a publication of a statement of alleged fact which is false and which harms the reputation of another person.(1) Our right to freedom of expression is restricted when our expressions (whether a spoken slander or written libel) cause harm to the reputation of another person. The courts recognize that words can hurt us, for example, by harming our ability to earn a living (economic harm).

Maybe this poor Californian Lawyer is pulling this legal chain - But how would I Know, I'm just a Furriner and an Aussie to boot.
 
If that was always so, Gary Trudeau would be out of business. And he does it for a living, in front of a wide audience. If his speech is protected, us little guys yelling at our keyboards are free and clear.

After all, they can always say they only hit him with the same routine they use on anybody who comes online to tell them what to say or what not to say. They don't really know him personally, so they can't say anything against him that's personally valid or, therefore, personally injurious.

That would be so even if he were an Australian! :D
 
Hmm, sounds like someone might be a tad thin - skinned. Being a lawyer, unfortunately, means, among other things, dealing with insults. I don't belief Mr. Galton's suit against Yahoo is going to do much to restore the public's respect for legal profession.

Esav, this is what you get when you live in a country with 5% of the world's population but 70% of the world's lawyers.

Hmmmmm.. well, parts of it do, is that enough? :)

My part certainly does, after all, what could be classier than cattle, sheep and wine country. Those tacky bits around the cities leave a lot to be desired though!
 
Again with California! Sheesh. This used to be a nice place when I was a kid.
 
My mother-in-law lives in California and she's barking mad.

This is a state I will be avoiding on my future trips to the US.

I didn't send her, she's always been there, I just rescued her daughter and took her to a nicer place. :)
