What should I do to the seller

I need some opinions. I won an item on E-bay for $300 and sent payment overnight the next day. Today, which is four days later I get an E-mail from the seller that says "The item was pulled from E-bay and not available. I don't want payment." There was nothing about recieving payment or retrurning payment just that message. She will not respond to any of my E-mails.
Whats my recourse? She did not "pulll" the item, I am shown the winner and it shows "payment sent".

Is this not a contract?
 
Not my area of expertise but I believe there is a way to contact the admin. on Ebay to file a complaint and get things started. Does this seller have similar complaints on their ratings? If so perhaps you could contact the complaining Ebay member(s) and see what they have done. I am sure those who are more experienced with this type of situation will chime in soon.

BTW: How did you make payment? Personal check? Money Order? Cashiers Check? etc... (I am betting one of the later two).

Yes, you have a contract, and she has violated it.

The moment you placed your bid, the Ebay screen says your bid is a contract to buy.
 
sounds funny alright but first off save all emails
if you used paypal you will have to wait a while 30 days? and then file a item not received claim if it was money order if it doesnt get returned maybe you can get them on mail fraud?
but by all means try to contact ebay customer support and have item numbers and receipts ready you will have to email or fax copies to them probably
i went through both before and in the end it worked out just took a long time

Don't forget to post that bastid's user ID here so the rest of us can avoid the seller like the plague!!!!! I hope it all works out man.
 
Expose the mofo! What's the ebay ID? There are avenues through ebay, but good old fashioned threats (nonviolent) don't hurt either :D
 
I would also involve Ebay immediately through the use of the Dispute area. There is also a function in the dispute area where you can immediately request her other "Contact Info". You will be sent by email her Telephone number and her address.

With this info, you can harrass... errr I mean call her and request a refund. (or several of us could call her for you and request that she give you a refund) :D Also, you can use her mailing address to send a "Signature Required" letter stating the same.

DO NOT GIVE UP!!

Also, please post her Ebay I.D. as other Ebay members could put out her name and the circumstances on the Discussion forums there.
 
i dont know how that affects it but did you notice a day before the item ended the seller stated they were no longer selling it ?
you never mentioned yet how you paid if by paypal it should be fairly simple but a cheque or money order could be different
so maybe they sold privately and if so and if you sent a cheque or money order it would take some time to be returned
 
I see where the message was added at bottom of auction where seller stated it was no longer for sale. Maybe new to ebay (only 11 feedback) and didn't realize that there's a way to cancel the auction altogether...either way, if the seller let the auction run it's full course, they are responsible for 1. either sending you the item, or 2. refunding the money which they surely already received as I see by your first post that you sent it overnight. You have a legitimate dispute. Let us know how it comes out.

Looks like this was an ebay newbie who didn't know the proper way to end the auction but made an effort. I'm afraid you're going to have to chalk this one up to experience....
 
Yup Cougar you are right. I paid by Money order so hopefully she is honest enough to send it back.
 
try cancelling it then its just dead paper she got but a person still likes to think she would return it
 
Wolfie, take the money order receipt to the nearest post office, explain the situation, and tell them that you want the money order cancelled immediately.


While the seller posted that the item was no longer available, prior to the close of the auction, it should be their responsibility to terminate / close the auction using the eBay's prescribed procedures, not by leaving a note at the bottom of an auction page. The sellers ignorance of the procedures shouldn't be worth $300. ;)

With that said, I would also contact eBay and lodge a complaint.
 
Thanks Gig I did that this morning and the sucker has been cancelled. All of a sudden she E-mails me to advise that the Money order is being returned overnight to me.

My bet is that when I told her the MO was cancelled she decided to send it back.
I also screwed up when I left her feedback, I forgot to click negative but the write-up sure is negative.

Oh well another Ebay lesson in honesty and integrity:rolleyes:
 
well i am glad to hear you got your money back but it would have been interesting to see if she would have sent it back on her own , if she had tried cashing before sending it back to you i am sure the bank would have made a note on it but then i guess she could have just claimed shehad never received it
at any rate i am glad you caught it in time
 
You WERE getting a kick-butt deal. I'll bet she got cold feet not seeing the price skyrocket to her 'reserve'. Or she got another private offer.

In the end it's worked out. Kinda. One of those 'lessons we learn' when there is an opportunity to save $400.... :D

I'm sorry to read that you got screwed on this eBay deal...It looks like it is/was a nice unit.
I can't believe that she had the balls to charge $25.00 for USPS Priority Mail, 'tho...:barf:.
