Yup. Can't shoot someone after you have their weapons, unless you can really justify it. When my father was still walking a beat in DC (way back when), he ended up in a confrontation with a big guy. At a certain point, he drew his nightstick and attempted to strike this nutjob. The guy caught the end of the stick barehanded and snapped it off the base. My father is left holding the handle and the perp with the whole stick. Luckily, when my father drew his gun, the guy sobered up and allowed himself to be cuffed. If not, he would have been justified in shooting this individual, since the guy was so obviously capable of doing more damage barehanded than most people could with a bat. The moral is that 'justifiable' is not like a quick checklist, but depends on the situation, which is why juries rather than computers decide trials.

After you are attacked and have defended yourself, hide all the knives you have on you into a bush somewhere when you or a close friend can retrieve them later and then either take the knife you used to defend yourself with you to the cops and forget about the rest of them

You are lucky you live in the USA. Here in Belgium, if you use a knife as a weapon, the murder becomes intentional, whatever the situation is. And that'll be 5 - 10 years, no way of avoiding that.
I once got into a bar fight, and my oponent, obviously drunk, opened a butterfly-knife and stabbed me in the arm. Since then it was very clear whatever I did was selfdefense, I still did not pulled my imitation CQC-7 (Homeij made, 420 13 cm blade), instead I tossed it out of my pocket, so I couldn't abuse it. When I had it in my hand, I could have easily cut the dudes troath in one slash. When he attacked again, I remembered my course martial arts, broke his knee, nose and arm. Result, I told the cops the whole story, gave them mine and his knife, and got charged for beating the dude up and carrying illegal weapons ! The dude got charged for attempt at murder and carrying illegal weapons. I got off cheap (500$ fine), in court one year later. The dude got a fine of 1500 $.

Moral: don't use weapons in combat, they sooner (in battle) or later (in court) turn against you. The best weapon is a direct blow of a fist straight to a nose. Guaranteed to knock anyone out with one strike. Does hurt like hell on you hand.

Bart, one day you are going to punch someone straight in the nose and when they don't drop like a rock like you expect you will realize how many blows a person can take. One blow will rarely take someone down unless it is in a very vulnerable spot.

If you use a weapon you Will be arrested. Cops dont make laws or determine guilt. They make an arrest and let others decide. A prosecutor is going to eat you up in front of judge and jury as a rambo wannabe if you carry all that hardwear. Second according to my NYPD freinds after my arrest, "It dont matter to us who is right or wrong we just arrest the winner and take the loser to the hospital"

The subtleties of defense and offense in a real confrontation are such that there is no way to determine when is what, so you had better make sure you need to do this before you start. IF you can run at any part and dont you are wrong. If at any time you get an upper hand and dont halt aggresions you are wrong. Meaning if you stab him once and the court feels the assailant was incapacitated but because of the adrenaline rush and fear you stab him a few extra then the few extra will get you. Make sure you absolutly have to use that knife because under most circumstances you are going to jail and doing time. It might be worth it but only you can decide.

Ok THe "my arrest" part in my last post sounded a little mysterious so I will relay a story of how quickly a situation turns against you. No knife content but it applies. I was a supervisor with 5 people on my staff at a small row boat rental place in NYC. I was about 27 years old. I had a problem with two of the employes and there was a near physical thing but they backed off promising to get me. They showed up to work the next day and everything seemed fine. Around end of day this guy shows up who I never saw adn begins to curse me and threaten to "smash my face" Im about 5'9" and about 200lbs. I lift and always have but this guy made me feel little at about 6'2" and 250. I didnt know why this guy was messing with me until I saw the grins on the two employees. This must have been a freind. GUy came in the gate and started to scream directly in my face. As he worked him self up spit started to fly from his mouth on my face adn I was backing up to the fence. I believe that when you have decided there is no choice hit first, hard and as much as you can. I finally stopped backing up and asking him what his problem was and said your going to smash my face mother**... and reared my head back and smashed him on the nose as hard as I could with my forehead. I didnt know that blow had knocked him out instantly so when he started to fall foward I thought he was doing what most big bullies do, they come charging. As he fell I grabed a boat oar and smashed him along the head and once more on his trip to the floor. I was arrested and was charged with FELONY assault. Why ?? I used a weapon and I hit him while he was unconsious when I could have fled. The whole fight from first blow was 15 seconds if that. How the hell did I know he was out on his feet. Over a year going back and forth to court wondering how long I would get. THey were talking about six months to a year. I spent fathers day in jail awaiting arraintment. And it gave me a record that HAS ruined some opportunities. I would do it again tommorow but there was a price to pay. Sorry to be a drag.

I just wanted to post a note to the effect that not all of us are that well trained that we would be so confident in the face of threat of bodily harm. If someone was standing there threatening to beat the $hit out of me, and was either bigger than me or armed, I would make sure he goes down hard and fast and that the earliest opportunity he has to wake up is either in hospital or in jail. Despite all my martial arts training I'm not really that confident.

Firstly, can I disarm him without putting myself to grevious bodily harm and at the same time without excercising excessive force on him? How much is excessive anyway? Should I draw my knife and spill his intestines before reaching for his weapon, or can I put in a kick that would knock him out or incapacitate him or make him drop his weapon? And can I be sure that my kick will actually incapacitate him? Will my punch to his solar plexius find its target and contact with enough force to put him down? Or will I find, after putting in the punch and stepping back to allow its effects to occur, that I've not contacted solidly enough and that not only is he still standing, he has taken the opportunity to close with me and is now engaged in beating the $hit out of me.

No. As I said earlier, my response to such a threat is the same as the SAS. The threat is not eliminated until it is on the ground and disarmed. (For them, that usually means shooting the bad guy until he falls on the floor dead.) So if Mr. Bad Guy is still on his feet, I'm going to keep at him until he drops. Maybe if I've managed to effectively disarm him, ie his weapon is not within the immediate vicinity and he doesn't seem to be pulling any more out, I might just put away my weapon. But that's not likely. Not until he has hit the floor.

But inspite of all that I've said, and my personal conviction that I'd rather be tried by 12 than carried by 6, I have an even better conviction; that I'll do everything to prevent myself getting in to such a situation in the first place.

Well, I am glad I live in the Western US where we are still allowed to defend ourselves. I am an LEO in Washington, and though it is a pretty liberal state, our citizens right to self defense is pretty well protected. If we go to a scene of an incident and can determine that it was, in fact, self defense, we don't take that person to jail. Since when do we arrest victims? From there it is up to our major crime investigators and prosecutors to decide what to do, but if the detectives don't recommend charges to the prosecutor, there is a VERY slim chance of getting charged.

One caveat though, hiding any knives after the event could look really bad, especially if someone saw you do it but you didn't admit it to the investigators. It would look like "If you are innocent, why were you hiding them?"

Also, once an investigation is concluded, all evidence can be released to its owners as long as possession of it is not illegal. But don't expect the police to offer it back to you, you need to request it.

I used a knife in defense against a larger opponent who was choking me from behind..The LEO's who arrived were understanding and positive..I was never arrested nor did I ever have to go to court.I was called to give a deposition but never had to as he plead guilty..never did get that knife back

In most others lawyer up.

The people who have problems with a rightous kill are the inocents.Even cops,who should know better,talk.Your best bud will write down what you tell him.That`s his job.This can come back to haunt you.You don`t know all of the law.There could be something that you never heard of.

Don`t talk!That`s are what lawyers are for.

I`ve been lucky and made a statement,and the charge went away.No monetary pain.But I knew exactly what I was doing,I think.
