Monday June 4, I will be going to court facing charges for exercising my right to carry a legal knife on my college campus.

That's really bad luck. With all this anti-gun stuff going on, sooner or later knives will come into the picture. Then we'll all have to worry abou this kind of BS.

I think sueing them is the right thing to do. Show that PD that they can't just do whatever they feel like and get away with it.
 
Wow, please give regular updates (find out if your lawyer thinks its ok to tell us this) about this case. You were really given the shaft. You know, most cops are probably decent people, but its the rare case such as this that give people a fear of police in general. You appear to have done NOTHING wrong, yet its costing you money and time to prove this, probably because somebody who doesnt like you filed a false complaint. If you find out who that is, you should also push to have them arrested for filing a false report.

Good luck in your case, from the sounds of it if your lawyer is halfway competent you should walk away from it. Then sue the pants of those a-holes! That's infuriating to no end. This is a case where civil action is more than the frivilous whining that appears too often in courts.

Solid If you should feel that your attorney is not helping you the way he should, and things just don't seem to be working out, I think you would find yourself in very good hands retaining John Smurr. Just my 2 cents.
All I can tell you is that this guy has helped a lot of people with much more serious charges stay out of the pokie. Also the more you have your attorney continue the precedings to a later date the better. The judge and Da have much bigger fish to fry, and will get tired of seeing you all the time so chances are they will work some type of plea if it even goes that far. I hope every thing works out for you bro.

Man i just got off of work and started reading your whole posting, man that sucks. And to think this is what I have to look forward to when I go to college(hopefully at CPSLO) i'll have to be sure to check their laws because i carry usually larger knives and very expensive ones(not customs benchmades but they are a lot of money to me.) But mainly i agree prosacute these @#$%@#$#@, i'm sorry these wonderfully misguided individuals. But i like the idea of transfering schools with enough money to go somewhere else or stay there whatever but enough money left over for youe BMW, lexus, mercedes and a handful of customs u know necessities. but mainly because of this injustice. I mean the laws already suck enough in CA don' t make them worse by charging for something you didn't do. So I hope that you win and may God be with you. And let us know what goes on tomorrow

PS does any knowledgeable pepople in here know what the laws for a concealed fixed blade are in CA. For my next purchase i was thinking about neck knife but i want to know what the laws are thanks and maybe someplace offical that cites where you got your info thanks again.

It's illegal to carry fixed blades in California, doesn't matter what length it is.
 
Illegal, I understand, in terms of carrying fixed blades which are concealed, but I have not heard of any specified length limit. However, some cities specifically do outline fixed blade length limits.

Also, since Mhael will be attending a California State institution, I'm sure the same laws which affect Fresno State also apply to Cal Poly. You are probably better off checking with this school before you attend.

I just got back from court. My attorney is VERY competent. He is sending me the police reports so that I can find any discrepancies(sp?) between my story and the PD's. They had xerox's of the Strider and my CS Triple Action. The Cold Steel had been in my dorm, broken after 3 weeks of flipping. I had it held together with wire, hoping to fix it over summer. In it's present condition, it was inoperable.
Here's the kicker:
They labled both knives as 4" blades. Neither of them had an actual blade length of four inches.
My attorney thinks the prosecution may be confused (or may be trying to pass it off as) thinking that the same laws applying to a K-12 campus are applying to me.
In other words, they have no case. My next court date is the 26 of June.

I would like to thank all of you for standing behind me on this one. It's been hell, and it ain't over yet.

Soldier - Sounds like things are going alright, good. I hope it alll works out for the best. If they are trying to measure blade length, for which there is no legal limit for folders on university campuses, I believe there is California court precedent for measuring blade length by the cutting edge, not "full stabbing depth." There was a court case linked from James Mattis' web site, which is no longer up, involving a Leatherman tool, and that's how the blade length was measured.


For those of you who don't know CA Law, basically, you can carry any size folding knife, concealed, so long as it's in the closed position. Switchblades must be under 2" You can carry any size and style fixed blade, as long as it is not concealed. Look at Penal Codes 653k and 12020. For university campuses, see 626.10b, where it says that you can carry any size folding knife, but fixed blades must be under 2.5" A search in the Knife Laws forum will answer just about all of your questions. If you want an absolutely reliable source, go to the state legislature's web site - www.leginfo.ca.gov
