Bad Things Happen

Like everyone else I'm glad that things aren't going to bad right now. I hope that you will prevail and that the poor misinformed(watching my language) opposition will be repriminded severely. Also thanks for the clarification on the laws, all i have to say is that it sucks, so I can't carry a neck knife, well maybe later, when i have more money i'll buy a good sized fighter to carry openly but we'll see. Thanks again

And also solid is there something in the university law that says how they want the knives to be stored in the dorms, like would they like it better in a nice display case or what? well good luck.

To add briefly to Medusaoblongata's excellent summary of Calif. law, you should also check your county code and city ordinances. Here in LA, the city and county laws do not permit open carry of any blade three or more inches long. Many LEO's I've asked interpret that to include concealed carry of folders. I don't agree, but if you ever take out and use a concealed folder with a blade of 3 or more inches, it is certainly "openly carried" when you are using it.

Note that there are exceptions for legitimate vocational and recreational uses of blades over 3 inches.

Boy, Solid, that really sucks. I saw your other post a while back and I just thought about it the other day. Sounds to me like you'll probably get off, but what a hassle with court fees and such. Where are you living now that you got kicked out of the dorms? You should be reimbursed for that, too, IMO.

Wow, that really sucks. Did your lawyer show the DA that the law only applies to K-12 shools? It seems like that would get them to drop the charges... but hey, that's Kalifornia for you.

This forum can easily make hundreds of emails get to the dean's office...

No foul language - just honest thoughts from law abiding citizens that will NEVER send their kids to this college...

sorry about your bad luck - is the school threatening to hold your transcript, kick you out, etc?? how long have ya been going there? best of luck, ya need a lawyer for sure - hope it all works out - at the university i went to weapons were strictly forbidden, although this was never enforced - had to go out of town 1 wekend and took my back pack w/books etc - also for the trip put in a colt combat cammander .45, loaded hammer back safety on - of course, monday i forgot about the gun in the backpack, went to class in a hurry (work 2 jobs and go to school 15 hours a semester and ya are always in a hurry) sat down, opened backpack, and ******oh ******* - calmly stood up, walked out the door with the backpack after closing it lol - took it to car and deposited it in the glovebox, and no, at this point in time i was not involved w/law enforcement/nor did i have a license -OOOPPPPSSS - dumb thing to do imho - but i carried a pistol, in my car, technically against the rules, every single time i went to class, had to drive almost an hout to/from school, at night usually, so i always carried 1.

Just my .02 here but "cocked and locked" doesn't strike me as a very good way to carry an auto in a backpack. If you've got time to go for your backpack, open it and find the gun you've got time to either cock it or depending on the model of your auto, fire the first shot with a long trigger pull.

On a holster I can see a benefit if the shooter is well trained but not in a bag that will inevitably have other items in it. It seems to me that the saftey on a 1911 model could easily become disengaged.
 
Solid - my support to you! This could happen to anyone one this forum and the (sad) way thiings are going it may happen more often. I hope justice is done!!!

those **** head cops. they are pissed because you made an ass out of thier intelligence of you "allegedly" having a fire arm. So they are making your life miserable just to prove they still are the boss. Hey it doesnt cost them anything to try and make an example out of you! Just the taxpayers pay for this crap. Typical cop nazi bull****. I would definatly sue the bastards after this is overwith and the judge throws this right out of court. My advice dont eat at any steak resturants in the next few weeks if they see you cutting your steak they might bring you up on charges of animal cruelty.

I do share solid's pain but you know guys sometimes we are our own worst enimies. I love my "Steel Children" as much as the next guy. But you know sometimes we like to show off. Now maybe Solid talked to the wrong person inadvertantly and they being one of the Sheeple decided to "Pimp Out" one of our fellow knife knuts. I have learned one thing over the years being into guns and knives both is that you keep your mouth shut around people you do not know very well about your passion for steel because they will always take you wrong for it .
I always carry three knives when I am on duty and usually only one when I do not. when I am out socially it is my Sebenza . It is a knife that need no explaination here and it is very simple but beautiful in form and function. Also when asked about it, i tell people that I like the finer things in life and this is one to me. If someone asks about my "Children" I do not tell them about all I have because then I get branded as a nut. Around fellow knife knus I will talk all day.

i sometimes fell that we should not talk to openly round Sheeple about our passion for steel. I wonder if Solid said something inadvertantly infront of the wrong people and they decided to pimp him out. I usually only talk about my knives in front of other knife knuts. If someone asks about them i wil explain but usully keep it short sweeet and professional. that way no one can take me wrong

Well here's the good news. We can speculate all day long about "local rules at this school", or "local city/county ordinances", but it doesn't matter.

They've charged him under the state Penal Code regarding carry on school grounds. And as Jason noted earlier, there ain't no ban on folder carry on college/university grounds, as long as the folder is legal under PC653k - which the Strider and everything else he owns is.

They've totally screwed up. I've seen this before, in the "sword arch case" some of you know about...but Soldier's case is a lot more clear in that he absolutely broke no laws.

He must counter-sue over this crap, and nail them to the wall. Cops can't make up the law as they go along, that's the road to total chaos.

Because of the manner in which you were treated, and your residence searched, I think this Lawsuit should be in the millions of dollars.

Tell your Attorney to sue for 50M. That way, You get 10 in today's society.

Sue them for 50M and a complete erasure of your record including the entire arrest record, if you have to settle for one million, you will not be sad, will you?

Take your money and find a real State, because that State, as beautiful as it is, is beat and the inmates are running the asylum.

This is hindsight, and thankfully unnecessary in this instance. Nevertheless, given the problems you've faced, the chances something of the sort will occur again are very real.

Never allow a search without being present. Someone could plant something in your digs. Worse, a crooked cop could plant something while doing the search. Please don't think I'm "anti-cop for saying this, but you just had it proved to you that police often operate way outside the intent of the law, sometimes outside the letter of the law. CYA always!!

Good luck in this situation. However sick of it you get, I believe you owe it to yourself, and to other potential victims of such crap to pursue civil litigation. And, I strongly agree with Jim March, that you must press a wrongful arrest charge against the arresting officer. If you get anywhere near a grab on his short hairs, twist them til he screams.

I'd also push as hard as possible to learn the ID of the individual who made the complaint against you. HOpefully, your attorney can get it in discovery before arraignment. If you succeed, think of a legal, but nasty as possible, retaliation. I have my sincere doubts that the cops can get by with some silly **** about a "reliable informant."

Any Police Officer that would try to ruin someone's life in this manner, for nothing, does not deserve the respect of the Citizenry. The Officer(s) involved should not be Police Officers anymore. Furthermore, they should lose their house(s) if necessary in a lawsuit to show them that they violated someone's Civil Rights.

I have no problem whatsoever with what you wrote, because an Officer that would trump up charges this serious is quite capable of planting evidence as far as I'm concerned.

Police Officers have to understand that they hold a great power to do good and they also hold the power to destroy.

The best criminal law advice I was ever given came to me in three simple instructions:

1) Shut Up.

2) Don't talk.

3) Say Nothing.


All things have their place. If this guy's lawyer is any good, why are we reading this on the internet? (See #1, #2 and #3 above...)
 
4) if ya didnt call them (the cops) you probably dont want to talk to them....
