Responded to his add for Italian stiletto (Walt's Latama) for sale. Agreed to pay $125 Paypal and further agreed to send money designated as "gift". He last said he'd ship upon receipt of funds. This was on 7/28. I have not heard from him since. Tried contact through here as well as his email. He closed the F/S thread. I have contacted Paypal and am hoping for some help. I always hate to call some one out....but he has not responded in any way. I hope I can retract this accusation, but hope is fading.:grumpy:
 
Sent him a message. He was online just a few days ago.

If you sent "gift" paypal most likely will not be able to do anything.
Hope shipping was delayed for a good reason.
 
Never pay for a product with "gift". Because then you aren't paying for anything. You're giving someone something. You broke paypals rules. The rules are there for just this reason.

I sure hope you are right. I've been internet swapping knives since 1998 and always felt staying in touch helped every transaction. I've had ZERO contact since the payment was accepted. BTW....for the most part, I've found knife guys are the most honest and straight up traders on the web.

I sent you a PM yesterday you may not have received. Are you saying you bought and paid for both knives? I'm happy you got what you paid for and hoping Mr.OConnor will just return my money if so. I did notice Mr. OConnor had visited my profile but choose not to contact me.
 
I snagged both Italians right after he posted them via PM. I'm sure if you sent the money he will step up and send it back. I left him a message in feedback regarding this thread.

He sent him the money on July 28th. He did not step up and send it back. He flat out stole it.

He never should've told him they had a deal if he was selling them to you. He did it on purpose. If not he would've sent the funds back to him the same day.



BTW- Why hasn't he posted here I wonder ?
I would like to hear what he has to say about it.
Hope he's banned soon if he doesn't respond here.
 
I just looked and the thread was almost 2 months old when you sent the funds.
edit- the same knives were listed again last week. I saw were the OP replied in the old thread, and wasn't aware of the new thread when I first posted. The OP paid from the second thread.

He is/was a new member with only the 2 sales threads, so I doubt he really cares if he gets banned.
The knife was probably gone by the time you paid, and it looks like he just flat out stole from you.

Contact his local authorites if you haven't already done so. He may have done stuff like this in the past.


Also, If you paid with your CC through Paypal call your CC company and tell them what happened.

I don't have a dog in this fight, but I need to ask for my own edification: Does a private message within the forum's system trump an "I'll take it" post in the initial ad?

"Selling" goods you have already sold to another does not sound like just a breach of contract. It sounds like larcency by trick. This would also be Mail Fraud if the U.S. mails were used for payment or were to be used to ship the goods to you. Federal prisons are unpleasant places and there is no "time off for good behavior" under federal sentencing guidelines.
 
Not much help for the OP now, but this brings up some issues that have been bantered around this forum for quite awhile now.
1. Don't pay with PayPal gift and expect ANY type of resolution.
"Hey... Uhm I broke your rules, now I've been swindled, can you help me..."
2. Some type of BF mandate should be implemented so that a For Sale thread must be Closed after the knife has sold. Posting was Two months old? Maybe for future reference a PM should be srnt through BF to the seller asking for details prior to purchase on a thread that old. Nothing more frustrating than finding a great knife only to realize it was sold already.

Now my next point, How did you know who to send the money to? Did you PM seller that you wanted knife (knives) and he provided you with his PayPal info so you could make purchase AFTER seller had already sold the knives to 'redradr'?
If that is true (and the dates can be verified),That is a scheme to defraud and needs to be addressed by BF Admin.
 
I replied to his "priced to sell" thread on 7/28. Sent him a PM a few minutes after the original posting time. That would have been well before OP's time stamp. If he accepted the money from OP he needs to refund it. My deal with him went through smooth as any I've had.

This appears to have been a same day transaction and perhaps you still have some options available. See if PayPal can tell you if your funds have been withdrawn by the seller. Since you put up the funds they should be able to tell you. If they have not been withdrawn yet ask for them to send back to you.
In a paypal transaction, PayPal deducts funds ftom your provided source immediately but that is not indicative that the seller has been paid yet. If you gifted the funds they may still be being held by PayPal. Just a thought.
I have sent my sons money and I put up my MasterCard a source. My card was debited by PayPal the moment I hit 'Send' but my Son did not receive until two days later. My Son had to acknosledge the gift in order to receive the money. Perhaps the seller has left the funds in PayPal? I'd check that out.
 
Since you paid via gift the only real option you have is to contact your credit card directly.
