Earl's site was suffering from a lack of "top-down" direction for a long time now, making the "great exodus" over to Tacticalforums (or something like it) more or less inevitable.
The new buyer *did* in effect get screwed. The question becomes "who screwed him" - the TF people don't seem to be to blame. IF Earl knew about the impending evacuation to TF at the time of the sale, Earl becomes the guy giving Jim the shaft. In my opinion. Whether or not the sale constituted actual illegal fraud would depend on the contract and just what Jim thought he was buying. If the contract listed "UBB s/w, server hardware and domain name", he's probably SOL unless he can make a claim to the effect of "the implication was I was taking over a going concern versus a dry husk".
I don't know if the dollar amount is high enough to make asking a lawyer (which I ain't) worth it. The server hardware is worth bux, the UBB software less so.
Mike, would you be interested in buying the old KFC posts from Jim? What's left of 'em, anyways? Depending on how much, I'd be willing to chip into a collection pot. We could make 'em available in an archive subforum or something, or in some cases import them wholesale...old HI stuff into the HI forum, ditto Chris Reeves, Donna's spot, etc.

Jim, have you actually given Earl the cash yet? If not, I guess you have backed out...if so, maybe Mike can make that sort of deal with Earl?
