I just got out of court two hours ago. My case was dismissed. That's what happens when the police call a folder a fixed blade. I'm happy to let the forums know that this is the end of the Strider saga.

I'm still going to sue the bollicks off of the campus PD

I also congratulate you on your victory. However, at the risk of raining on your parade, I offer you a bit of unsolicited legal advice. As a litigation attorney, I can tell you that any lawsuit (but especially one against a government agency) is going to be very time consuming and expensive. I know you are upset at the cops and their idiocy, but what are your real damages? Did they beat the sh!t out of you? Did they imprison you for an unreasonable amount of time? If not, your damages are speculative at best and will be very difficult to prove. This will entail complex legal discovery procedures such as requests for admissions, interrogatories, depositions, and expert medical opinions, all of which cost mucho $$$$$$$. If all the cops did was cause you aggravation and deprive you of your knife for a while, you may be SOL. Don't expect to retire on what you may end up getting.

Excellent. As I have said before, it is vital that you continue to pursue the matter fully. It is only by forcing accountability that we can encourage our authorities not to abuse their positions. If we let a criminal "get away" with his crime, then he'll probably do it again. And if we let our authorities "get away" with such an abuse, they'll probably do it again.

congratulations, i agree with gollnick, it's important to pursue the issue, but having been in court before i know how expensive it can be. hope you get your knife back and if you do decide to sue let us know how it all works out. Congrats again. Pete
 
As was previously mentioned, a lawsuit is extremely expensive and emotionally draining. There is another option: if you can publicize this situation to the general public and embarrass the Campus PD for their ignorance of the laws they are supposed to know, at least you can "get a cheap shot at them" without spending a lot of time or money. Basically expose them for being the buffoons they are for pursuing this issue even after it was obvious they had no case. You would simply be excercising freedom of speech and exposing facts! They don't like to be embarrased or proven wrong and bad public relations is death to their department. You can even throw out accusations, as long as they can't prove them wrong then you may be right! Good luck and don't let these goons get away with s#@%!
 
It's great that Solid_Soldier was cleared. However, He's out a large sum for legal fees in just the criminal case.

It's was a win, but a costly one. That Buck Strider may become the all time champ for most expensive production folder.

This is why abusive or incompetent law enforcement is a major issue in a free society.

That's for damn sure... $2500 for the lawyer and $500 to bail me out of the pokey... that's $3000 for a SB1, not counting taxes and shipping.
We are definitly going to sue. Several of my rights were violated on this one, so I'm going to get my money's worth. It's kind of ironic: They'll be paying me to learn all the crim stuff that they were totally ignorant of... and ignorance is no excuse for breaking the law.

I do think the issue of false arrest is substantial. Not sure AGS knows you were arrested and spent a night in the jug. It's my guess that their weak suit is good faith when they arrested you. If the case had so little merit as to be dismissed, then at the bare minimum the department has a significant training issue. But, I'm sure you explained what the law was that night, so their arrest was in bad faith. They never even checked the statute to see if they had it right. I think the same goes, in spades, for the prosecutor. It is their responsibility to the state and its citizens to see that prosecutions are handled fairly. This was obviously just something to try to cover the police asses, IMO.
