Looks like the seller is from LA, perhaps he bought it from someone else? Have you tried contacting the seller?
 
I think you're SOL. There is no way to tell how many sets of hands the knife has gone through from you to the person selling.

Maybe file a police report, then buy the knife and reverse the credit card charges after you get the knife (thats where the police report comes in). And you probably get the seller's address on the package to boot.

So he never pulled though on his side of the trade? That stinks man... sorry to hear about it. Was the guys address LA?
 
Unfortunately there is nothing that you can do unless you have proof that the guy selling it on eBay is the guy who shafted you on the trade. You will need records of the shipping address and a GBU thread or something showing that he did not follow through on his end of the trade.. Good luck man, I feel for you.
 
If you file a police report, the guy on ebay is now guilty of selling stolen goods. If he came by the goods honestly he is not in any legal trouble but will be SOL when the police confiscate the knife and return it to its legal owner. You are going to need some damn good documentation to pull it off and prove yourself as the rightful owner and that it was stolen from you. It may be best for you to consult legal counsel or contact your local police department for proper advice as there is a meriad of things to consider. Good Luck!
 
I would put this in the GBU section here on BF, and tell who you traded it too. Someone might know who you traded with, and/or know the ebay seller.

I almost just asked him(on ebay) if he knew that it was stolen, and where did he get it.

Was the guy from LA? If you still have his address you may want to contact his local authorities, and send them the Info. I'm not really sure what you should do, but if me I would be trying something.
 
I'm not American, so I can't comment on your legal system (well, I can, but it wouldn't be pretty ;)), but where I come from, the only question would be whether you can prove it was stolen from you. If so, then you can certainly reclaim it or rather ask the police to claim it for you. Stolen goods are stolen goods. It doesn't matter if the current owner bought them in good faith, they are still committing an offence by being in receipt of stolen goods and would have to forfeit.

I would start by contacting the seller as it looks like he may be a collector who came across it from the thief or someone after him. Its also possible that UPS stole it and it ended up in this guys collection afterwards. They have stolen from my packages before, taped the boxes back up and said there was a weather delay. Regardless, if you can prove it's yours, you should be able to get it back by law.

They may be able to tell you what the best way is to handle this without spooking the seller that has it currently up for auction. Surely they encounter this problem often and I'd bet that both you & eBay want to get this person in the legal trouble that they may deserve. He/she is currently selling stolen goods regardless of how they came into possession of said goods.
I'd get in touch with Forager as he may be needed to prove sale to you, and get the documents that prove USPS receipt of delivery to this other person handy.

gprippers but it was after he was long gone from here and I was new and didn't know any better the trade was on jerzeedevil. the trade was this bm and dogfather for a nmfbm he signed for delivery but then told me it never came he also filled a clame to the usps I'm looking for his email and real name it was so long ago any way he is from southern Oregon but I think his son is in California
 
Your ebayer is typically a buyer. Selling seems a new thing for him. He buys an a$$load of para cord. On the right of the screen there is a place you can "report this item". Not sure what the result would be but, I bet eBay wouldn't let him sell it. Of course ... Then what? Is there proof here in a thread that you bought it. If so contact this guys local PD and email a link to the thread for the PD. it may be enough to get them to get info on seller from eBay and confiscate the knife. You better move quick before Louisiana is no longer part of America.
 
Here's an idea...

Why not report it to Ebay and then, after you hear from them, use buy it now.

That will tie up the knife, give you some contact info, and let you go through your process to get it returned to you.

It's stolen merchandise.

No doubt about it.
