Ebay knife purchase not as describe, what should I do?

Hi there, new to bladeforums, joined a long time ago, but just recently start collecting knives.

Anyway, not sure if this is the right place to post. I purchase an AL MAR sere 3005.6 fixed blade from Ebay on March 30th, received the knife today and I am disappointed at it. It was listed as a new knife, never used, but the knife that I received looks dirty, there are a few chips on the blade, and a couple tiny rust spots. I know that this knife was probably made 20-30 years ago, would this be an acceptable condition? I paid $300 shipped for this knife. Here is the original listing on Ebay.

With the description he have on the listing, would it be wrong for me to ask for a full refund? Or am I just asking too much, knife this age are like that?

I would communicate with the seller before sending it back. But send it back I would unless the description does not allow for an inspection period after receiving it.

After looking at the listing, it states that seller does not accept returns. So, you will likely have to deal with Ebay. Never done that. I stopped buying much of anything on Ebay a couple of years ago.
 
I'd say you're entitled to a full refund for sure.
The rust spots I could overlook, but that edge damage didn't get there sitting on a shelf for 30 years.
 
First decide what you want to do.

Is the knife super rare or something that you have been wanting for ever? I mean you can certainly
get rid of the chips in the edge with a sharpening, and can probably get rid of the rust too.

If you are totally turned off by the condition then I would contact the seller and ask him if he is willing
to do a full refund. Who knows whether he will comply or not, but you should be covered with Ebay or
Paypal's buyer protection and could go that route as well if you decide you want to return it.

Personally, it looks like a pretty decent looking knife, and if it's super rare I would keep it and just
put a little work into it.
 
Inspection period be damned. Not as described is not as described. One of Ebay/PayPal's biggest faults is its commitment to buyers. I would communicate with the seller, if they don't do the right thing and take it back file a "not as described" claim with ebay/PayPal. They almost always automatically side with buyers. It then becomes the sellers responsibility to make and defend their case. If you can't tell I'm a little bitter about this subject.

+1 on sending it back, but communicate with the seller and see if you can work something out. Don't underestimate the power of negative feedback. The guy may not be intentionally be trying to mis lead you. Give him a chance.

New: A brand-new, unused, unopened, undamaged item (including handmade items). See the seller's listing for full details.

That is NOT BRAND NEW! :D

True, for all anyone knows that knife was sold to him as new and he might not be a knife aficionado. You need to understand, some folks are much less OCD about things than others. He may not have even seen the edge. I've seen chips like that on a new knife that was fresh out the box, and I was the first owner. Things happen at the factory, and who knows what happened between the time that knife was made and now. I mean, look at the difference between your photos and his, does it look at all like he was set up with a light box and a high power lens and camera? I'd say it looks good for what it actually is.
 
If a return for a refund is what you want then contact the seller first, send him the photos of the damage and tell him you want to return it for a full refund. He listed it as New: A brand-new, unused, unopened and undamaged item. He states in the description that the sheath is like new and states nothing more about the knife condition. The seller has 100% positive feedback and would likely prefer to maintain the excellent reputation he has earned so I doubt you will have a problem but if he refuses then you can simply open up a case with ebay. Ebay will force a return given the circumstances (not as described) if necessary and reverse (refund) the payment.
 
Thanks for all the suggestion, I will try to contact the seller to see if he want to take it back. I do like this knife, but I want it to be mint, especially on the cutting edge.

It does not say the knife is new. Plus if you really look at the pics you can see the edge issues in the "zoom". With all the pics in the listing- I doubt Ebay will help.

I'm not defending the seller, I'm just sayin'.

I tried to zoom in on the picture too, with the granite counter top on the background it is really hard to tell. Also, under condition on his listing, he listed it as "NEW", and on the title of the listing, he also listed it as "Never Used"
 
The spots I'd let go, they look like they look like they'd wipe clean, the edge damage is a deal breaker.
 
The knife is not new.

Contact the seller. If he will not resolve the problem, then file a claim with Paypal.
 
I've returned items on ebay. I tell them what's wrong and ask if they have a replacement. (I wouldn't trust a replacement in your case.) I just notify the seller that I am returning it. Then I use Ebay's return process. That way it's clear. Once you return it and get your money back, the feedback button is gone which is okay by me.
 
Good for you! Ebay sellers always appreciate it if you contact them first to work out any issue before making opening a case.
 
I don't usually comment on this sort of thing. I looked at the pictures and the spots and "dirt" are clearly visible on my screen. I can also see what looks like tiny marks on the edge,
but they aren't as clear as the OP's pictures.

Keep in mind that just because an item is new, if it is old stock it may not be perfect. Things get handled and bumped.

This is true, however ebay's definition of new is very specific and old or new stock that has signs of being handled, bumped around, etc. do not meet that definition.
 
Ebay will force a refund. Their 100% buyer satisfaction policy is very biased towards buyers, but biased or not, if the item wasn't described properly. File the claim with ebay If the seller doesn't cooperate and I can tell you from a similar experience, they will side with you and force a refund....so long as proper payment channels were followed.
