EBayer double selling

"Won" two old khukuris on EBay from UK. Paid at once via PayPal.

Package arrived today. Entirely different khukuris sent - damaged goods and not remotely as illustrated -- not even close.

Same items are now on EBay to be auctioned off 12/12/03 -- very same pictures at least (I have both sets of pictures). Or are they? Who knows what these "winners" will actually get?

Can't find the right button to push on EBay. Do they even care?

I will contact the current bidders before the second auction goes final, but Holleeeee S @%%^$*&^%(^!!!:mad: :mad: :mad:
 
From my bad experiences in eBay, no they don't care.

Can you reveal the seller ? I believe forumites need to know about him/her.
 
You can claim fraud and use e-bay insurance to recover some or all of your funds. I know the insurance used to be $200 minus a $25 deductible, but I'm thinking e-bay raised it, especially if you use paypal. Request your money back from the seller - I'd advise not shipping anything back to the seller unless you have your back in hand. When the seller ignores you, go to "my e-bay", then scroll to the bottom and click on "filing a fraud complaint". E-bay will care when you formally make an insurance claim. BTW, pay close attention to the required timing to file your insurance claim.
 
It would be good to know which of the thousands of knife sellers on ebay did that to you. Definitely don't let the time limit go by on your fraud complaint because once you do, they won't do anything to resolve the situation. BTDT.
 
My guess would be that the seller is dumnonia_forum. Please correct me if I am wrong. This seller has great feedback. Have you not left a negative feedback?
 
Again, I want to give the seller a fair chance to fix this. I will post his name and the Ebay item numbers, and contact the bidders on the items I already bought before the auctions end.

I don't bid on items unless the seller has a good feedback rating - 99%+. Ihave still been burned before with warped, cracked, and seriously pitted blades -- defects that were not disclosed or which were actively concealed.

Thomas, I know you mean well but don't be surprised when ebay sends you a cease and desist e-mail. The watch guys went through that when they tried to warn people that the Rolex watches they were bidding on were fakes as well as some of the Randall knife enthusiasts when they tried to alert people to fraudaulent auctions. ebay doesn't want interaction between parties who are bidding and parties who are not directly involved. They cite a bunch of security reasons but there are those of us who believe they do so for $ reasons.
 
I lived 56 years before I ever bid on anything on EBay. Life will go on one way or the other. I will not see others subjected to this scam, especially long-time BF members like one of the bidders (whose e-mail address I have in any case).

If you are suggesting "legal problems," I confess -- I am a "legal problem" by profession. We have state and federal laws against fraud.

I was really interested in yor comments on knock-offs, there is a joint FBI-Customs task force working full-time putting sellers of knockoffs in jail - not a pleasant place to be - nasty. They nailed Got a of them in Cleveland in the last couple of years. Knowingly faciliting the sale of knockoffs makes you a co-conspirator - a federal felony. Not to mention RICO. Heck, there's a real opportunity here! "To dream the impossible dream ....":)

So here's where is rests.

The seller, Patrick Read (AKA Dumnonia Forum) has somehow removed the pictures of the khukuis I bought last month (even though they are supposed to be available) so one cannot NOW compare them to the pictures for the auctions 12/12/03 of 2208837534 and 2208838982. But I printed out copies. The pictures of what I "won" as 2205294978 and 220 5295649 are identical to those appearing on the above two auctions ending 12/12/03.

In fairness, Mr. Read has a 99%+ feedback rating. He says the problem is that I cannot remember what I bought and that there was a mistake about the pictures.

I bought four khukuris from Mr. Read alltogether. The two not being resold (my view) had undisclosed major defects - warped blade, pitting described as something one can "polish" away, back of sheath [not shown] rotted out, etc.). Mr. Read, for his part, says they are "good examples" and that, at least, split out sheaths are to be assumed. The two I received intead of what I bought (again, my view) have undisclosed problems: 1 bent blade; one wasted sheath, one sheath missing chape (metal tip).

Despite my raising the issue three times, he will not agree to pay the postage -- even for the return. He says he will "refund" when he has the items back.

This has certainly been an educational experience. I thought making copies of the pictures of what one buys was a pretty good insurance against getting something else. Guess not.:confused:

Sorry to hear it, man.. But thank you for alerting us to bad Ebayers.. I'm always nervous that things will go wrong, and it sure hurts when they do.
 
Can I make a few things clear. I was the seller on this occassion and I am not happy at the insults you people are showing. Do you not decide to listen to two sides before you judge? The buyer in question bought four kukris off me. When he recieved them he then accused me of sending him different ones to the ones he had bid on, apparently this was because I was reauctioning the same knives. However, this was down to computer glytch. I was selling two more kukris. These two new ones had the same web-host address as the ones before, therefore to anyone who had viewed my earlier auctions they would see the earlier kukris and not the newer ones. I was told this by several viewers and I remedied the situation then. I was not being dishonest and I tried explaining this to the buyer. To no avail. I have offered a refund if he is not happy, he wants the refund before he sends them back, NO WAY. But I will honour my refund if they return. So can I suggest that you all listen to both sides before you go slagging off sellers!
 
Why not refund his money first? He trusted you when he sent the money your way before he got anything. Excuses don't help, if he isn't satisfied then make it right!

My point is that I will not refund without having the blades back in my possession. But the last comment indicated that I should refund before he sends them! As stated earlier, I will refund when I get them back
 
After he pays the shipping on knives that you misrepresented with by showing incorrect pictures. The cost of shipping should be yours. Take responsibility for the fact that you posted a sale and used pictures from knives previously sold, not the ones you had for sale at the time. At best, an honest mistake, but one that Thomas should not have to pay for.
 
CAN I MAKE THIS ANY CLEARER. THE PICTURES THAT 'THOMAS' ORIGINALLY SAW AND BIDDED ON ARE OF THE ITEMS HE RECEIVED. IT WAS ONLY AFTER THE SALE CLOSED AND I REPLACED THE SAID PICTURES WITH MY OTHER KUKRIS THAT THE PICTURES CHANGED AND CONFUSED THE SAID THOMAS. IT IS NOT MY FAULT THAT THOMAS IS GETTING CONFUSED ABOUT REALISING WHAT HE DID ACTUALLY ORIGINALLY BUY. SO PLEASE DONT MAKE ME OUT TO BE THE ONE AT FAULT. I HAVE SAID I WILL REFUND HIM FOR THE KUKRIS THAT HE BID ON AND NOW REALISES HE DOESNT WANT THEM
 
Sure a man with no manners. Shouting. The buyer gave you money first, then received the goods. Not the goods he bought .. so back it goes... money first, then the goods. And, to get that right... everyone pays once for shipping.

Now even the people on the cheap seats should have gotten it.

Shouting in the forum won´t make you more sympathetic....:footinmou, but makes you look bad, like someone with the back to the wall.

Well, since Mr. Linton is a long standing, straight shooting member of this forum, I know which of the mutually exclusive statements that I listed above I believe. :) Personally, I really don't like people who deliberately or ignorantly over-rate their merchandise on ebay, but that is just me. Just for the sake of reference, no one has insulted you here. Though that may change if this thread devolves.

Hint for the future, Mr. Read - ALL CAPS does not make a poor argument any better. BTW, do you intend to pay for the return shipping or does Mr. Linton have to eat that in order to get his $ back?


Edited to add, I could see the photo on the second auction listed but not the first one so I can not comment on that aspect of this situation.
