Fired

Bro, every yutz that's ever been canned from the shop I work for has collected unemployment. Pretty sure it's there for when you DO get fired!

File for it, then move on to real work. Need I remind you, you hated that job... Time to make you some happy, bruv. Shack up at Vitale's - tell him I said it was okay. : )

Sam sorry to hear about all this, but I think the unemployment is the exact opposite. If you'd have quit voluntarily then you're not eligible, but since you were fired you should be able to get it. Of course your state laws might be different but definately apply for it. Good luck with whatever you decide to do. Larry
 
Sorry to hear Sam. I do not know about NY law but in Ca, the only place I applied for unemployment, there were several reasons they would not pay you. Quit voluntarily, Fired for cause, or you are self employed. I would still fight it. Many times the employer will not even show for the hearing and it normally goes your way. In Ca if you earned ANY money from a side business they considered you self employed. It always pissed me off when they took UE out of my check when I knew they would not pay it back if I were laid off. I have not worked for someone else since I found this out. But then I don't NEED to. Now get some steel hot and beat on it.
 
I fought twice in California, and won both times.
It took a while, but they back payed me.
Once the company didn't show up, and the other time they did, but still lost.
Said I quit voluntarily, when in fact, they asked me how I liked the job, and I said it sucked and was looking for a new one.
They canned me for it, and said I quit.
Didn't work in front of the judge.
Nothing to lose but a little pride in not taking the "dole" so to speak, but I always figured I spent years paying Unemployment Insurance, and insurance is just that.
It's wasted money if you don't use the insurance when it's time.

You never said why you were fired, and it's not our business unless you decide to tell us, maybe you deserved the firing, maybe you didn't.
If you feel like you didn't deserve it, I say file.

Always remember too that this is a public forum...

If you were fired or layed-off you are eligible for unemployment in California.

It's the other way around.
You can collect after being fired(unless you were stealing,or something equally heinous).You can not collect if you quit.

New York seems to have about the same standard as California.

You MAY be denied benefits if you:

Were fired by your employer because you violated a company policy, rule or procedure, such as absenteeism or insubordination

Quit your job without good cause, such as a compelling personal reason

Are out of work because of a work stoppage in the last 49 days that violated an existing collective bargaining agreement where you worked

Not definitely denied, but MAY be denied.
 
I would file. Filed once against one of the worst most corrupt places I've worked and they fought it. Got a new gig right away so I never had to maintain the fight. Now I work for an even more corrupt place :(
 
When you look for the next job it doesn't look good to say you were fired ! That's a mark against you especially in these hard times.

I'll agree here, especially if you did something to get fired. If however you got fired without good cause, a reasonable explanation of how you and the old boss couldn't agree on something, etc., told without making the old boss look bad, can often overcome this.

It's not a reason to not file for unemployment though. You paid for it, make use of it until you can get a new job together.

Are you sure about that? A buddy of mine just got fired. They gave him some wimpy excuse. Then hired someone to replace him so they didn't have to pay as high a salary.

How close to NY City are you? Ever considered working for the railroad? I'd be happy to ask to see if Amtrak is doing any hiring up there. With some of the jobs, you could work 2, 3, or 4 days, then have between 1-2 up to 5-6 days off. There is also NJ Transit and Long Island RR, which has some of the highest paid RR employees in the US. I'd be more than happy to make some calls and put in a good word for you.
 
Just be glad you are not in Colorado!

Heck, my wife got demoted at work because she was sent home sick, by the owner! She had a mild case of food poisoning and was throwing up, the owner (female owner, it is owned by a couple) asked her if she was OK when she left the restroom and my wife said no, I just threw up. This was in a resteraunt and the owner told her to go home. The next day she gets a call from the other owner, (the guy) and he tells her she is demoted and needs to give the company vehicle back that instant, it is her day off and that he needs to discuss this with her. She brings the company vehicle back and asks him what the problem was, that she was sick... he tells her
"this isn't the time or place for this"... and won't talk to her!

We tried to do something about it but were told there was nothing we could do!

She was getting her paid vacation the next week and hadn't missed a day in the year she had worked there, she was never late. She was employee of the month the first two times they voted for it and she managed the place.

On a side note, the owners keep the tip jar money, the kids don't get it! He gives some of it to charity so when people ask he can say some of it went to a good cause. These are high school kids for goodness sake, taking their tips is wrong! Even if they are tipped directly they have to give it to him!

We checked, it's legal.

in ma and nh if you get fired or layed off you can collect but if you quit your sol. hell, a good sized portion of the american population make a damn good living off of being unemployed. all you really gotta do now is have a few kids with different women and start an escort service and make all your cash under the table. what uncle sam dont know cant hurt him right? no but seriously, you seem like a super tallented guy, you will find something. good luck man.
 
Sorry to hear that Sam, But i am in agreeance with everyone. File for it, it is your right. And it might help pay the bills for a while :P On that note, You can put me on the list of your hammers :)

thats actualy a pretty good call. i know that they are hiring linemen on the hellgate line, thats a job out of sunnyside yard. sucks because its night work but its steady work, good pay, good benifits, and impossible to get fired.

No joke. I know people that have stolen plenty of money from the company years ago. Couple of them are managers now. Get past the probation period and then the union can help you out with any problems. There is even insurance that you can buy, run off or fire insurance. If you get in trouble and get fired for 10, 15 20 days (not really fired, but time off with out pay), the insurance can pay you your pay or more for all the time you are off.

Besides blacksmithing, what do you (or did you) do?
 
thanks everyone for they're advice, I'm thinkin I will file. Railrider thank you for your offer, I might take you up on it if needed. I got the summer teacher's assistant job at the Peter's Valley Craft Center blacksmith shop, I think I can figure somthing out between now and then.

I was a welder fabricator and general blacksmith for the shop I worked at.
