If you had any idea of the amount of time I spend in court on cases just like this or if you had any clue as to the amount of energy I spend fighting knife laws, you would know just how silly your comments are.
I've seen a few of your other posts. It sounds like you are on the right side. However, it doesn't sound like you are the guy that is paying the lawyers or sitting in the defendents chair. You are getting paid to be in court with no real risk. You are not putting your money where your mouth is. To blame Spyderco as the "bad" guy isn't helpful.
 
Ron, Fines are not tax deductable, they can only decease the profits of a company. Once you have plead guilty to a charge like this all your future shipments are on a stop and search list with Customs. This was bad all around for the company. If they used UPS instead of USPS they would have avioded the violation of one law and would have had a much better chance of fighting the other. He plead guilty because he made a few wrong buisness choices and violated the law ( a BS law , but the law). I wish he had fought it, but he did not.

In the "auots for sale " section on this site most of the sellers say they will use USPS and provide tracking data, and ask for payment in a USPS money order.....the sellers might as well plead guilty now since they have made an air tight case against themselves.....I do wish the Mods would tell them to follow the law in their ads here.....
This is confusing as hell then. I cannot see why Spyderco just caved in then. Of course like I said, I can't see why Balisongs are illegal either. Very few people know how to really use one outside of being acrobatic with it. I train with a Filipino Grand Master who is very proficient with the Balisong. But it takes a higher level of skill to use it correctly. Other than that, it is no different than any other knife.

Just curious here, does anyone know if its illegal to send fire arms or gun peices through USPO? I know you can send them through DHL, UPS and Fed X. Just curious!


By the way, I just noticed the moderaters are having a hard time with my signature. I apologize but I leave my signature with my contact info everywhere I go and always did it that way. Its habit by now!:D I will fix the problem!
 
You may send long guns with USPS but not pistols. DHL will not ship firearms at all. Fed-Ex and UPS will ship pistols but they must ship via overnight service.
 
There are laws and then there are the morons charged with enforcing them. The Postal Regs prohibit the mailing of switchblades except between FFL holders. I tried to mail some of my knives to a customer and the bonehead at the post office said that I could not mail ANY knives as I was not a "dealer." The guy couldn't even tell me what kind of "dealer" I had to be....lol. I went to another post office and sent them as I always do.

Your welcome Sal. You are correct, it is my opinion. A fool however, hardly. I also believe that I know you well enough to say that you are also no fool. You did what, you felt, was prudent for your company. I, however, believe that was very short sighted.

Call me a fool, say that I lack knowledge. That is fine. I do know however, that the matter of whether or not a swing handled knife (balisong) violates the Justice Code is still undecided. I also know that cases such as these have been beaten in the past. I know because, this un-knowledgeable fool, was on the witness list in the cases.

Just as S+W rolled over to the Justice Dept. in the name of prudence, I feel Spyderco also rolled over. Both cases were in the companies short term best interests and both hurt thier industries.

It is sad that your response is nothing more than a personal attack and smear. I would have thought better of you. I would never lower myself to make a personal attack against you.

while you may not have attacked sal personally, i think you should reread your posts about his company.

you were condescending and basically said you were going to boycott spyderco, as if making some sort of personal statement in this manner had any bearing on the thread.
 
There is a huge differance in saying that I dislike and disagree with what a company did, and then saying that I would no longer be giving them money, and attacking someone personally.

I know Sal (not super well, but well enough), I personally like Sal. Sal was even a standby witness on a case that I was the primary for. But I dislike and disagree with what Spyderco did.

For that to garner a personal attack from the companies owner, as I said, is nothing short of sad.

Ok now everybody pile on. What part of rant is so hard to understand anyhow. I have been accused of being a "mall lawyer" "a fool" "un-knowledgeble" only out for the money and several other pretty nasty things.

Do I get paid for my court testimony as a knife expert. Yes, sometimes obsene amounts of money. Many times I work as a volunteer and get paid nothing. Not when small things like money are on the line. No money is too simple. I am the one called in, when poeples lives are on the line. Most cases I am the only defense witness on a case. So it is up to me and how well I have my act together that decides whether someone walks free or spends the next years of his life behind bars. It is my butt on the line when I refuse to back down to DAs and Judges. I am the one spending at least 12 hrs per week researching knife law and knife cases.

So when a company chooses, for the sake of a relatively small amount of money, to make life harder for law abiding citizens, yeah I get a little cheesed off.

The next time you win a case when the judge tell you from the outset that he believes your client is guilty, feel free to call me a fool.

The next time you are called as to testify on a international import export case, feel free to call me un-knowledgeable.

The next time your personal and private financial information is ordered to be displayed because you dared to prove that a cop was lying on the stand, feel free to call a mall lawyer.

The next time you put your butt on the line to prevent an innocent person from spending the rest of his life in jail, feel free to attack me.

Until then, you should thank your lucky stars that some poeple are fighting for your rights and not just paying off a fine because it is easier.

And you know what? In over 80 cases now I have been proven right by the courts 100% of the time. That is one heck of a record for an un-knowledgeable fool.
 
first of all, i didnt say you are unknowledgeable or a fool.

i just suggested that perhaps your previous posts about spyderco were not as dissimilar from sal's as you would like to think.

i respect your opinions, and i think i have always posted in a manner that suggests the same, even though you have taken less than subtle shots at me and those in my line of work.

this last post is dominated by your ego, and i believe hurts your credibility.

I have had several cases in which the defendants were third strikers facing a 12020 charge or had 653k charges being used as a sentencing modifier. That equals a life sentence.

Before anyone says that they are scumbags and should have gone to jail, hold off. It does not matter what they had done in the past. They were wrongfully arrested and charged in THESE cases.

I have never taken a shot at you Morimotom. If you feel that I have, then I am sorry. I have taken shots at LEOs in general. I have seen cops lie, falsify evidence, tamper with evidence, file false reports, steal, make false arrests and in general have no clue as to what laws actually say. I have seen LEOs make jokes about rape victims within ear shot of the victim. So yeah, I don't have a very high reguard of LEOs (CA LEOs particularly). That said, my father is a retired officer, my mother in law is still an officer, I was a Federal Officer and I still am a air support pilot for the Sherrifs Dept.
 
well, since i work in california, any shot at california law enforcement is a shot at me (in a general sense).

we have had some exchanges and disagreements in the past, and i welcome the discussion in this regard. i have no problem with a disagreement with my opinion or interpretation.

but i think it important that we keep discussions about knife laws about exactly that. in this context, your opinions, or mine, about spyderco's decision are irrelevant. we dont know all the facts surrounding their decision making process, or ultimately why sal did what he did. his business, if he thought it was in the best interest of the company, his decision.

if you think sal's decision hurts your cause, then a rant about it serves little practical purpose. if it was my company, i probably would have responded in similar fashion given the way you presented your opinion.

You are not an insider in the case.
your money and company were not on the line. It was not a "relatively small amount of money". I had 150K in attorneys. (+ inventory and fines)
We had in fact imported some parts for the bali (illegal).
Your were not facing a mandatory 5 years (like the poor border patrol guards).
653K is a State, not a Federal offense.
I am also a court expert.
Kai/Kershaw is a 10+billion dollar company.
We are again making bali's as well as autos....legally.
My wife and I still own the company. ( how many times has S&W changed ownership?)
How much money have YOU personallhy invested in legal fights with the Federal government?

In my opinion, your comment was ignorant of the case facts and was not called for.
