Holding knives hostage? Advice

So a few weeks back I entered into a trade with someone by the name of Terrence Roberts, we had agreed upon my Spyderco super blue stretch for his cold steel recon one and Spartan. Long story short i send him my end without a hitch, his however comes to me an empty box with stamps on it stating it was received without any contents, and box was not assembled according to usps. I marked it return to sender and requested my knife back.

Now here we are two weeks later, Terrence keeps making excuses why his "wife" has not shipped my knife back to me, and this morning he says he will not send it back until he gets his empty box.

Any help on course of action. I get the feeling from his emails he's a scammer, but am not sure yet.
 
yeah word to the wise, just because you have a good experience and can trust other people you meet here-- always be wary, never send anything until you know your stuff is in hand, especially if you are the one putting it on the line (offering the trade etc)
 
It looks like he's done quite a few deals here with perfect feed back... it seems kinda weird that he would flake over a small trade like this.

Yeah it definately seems odd. What seems odder is he was supposed to have sent my knife back two weeks ago, he even offered to at first because his knives were lost in the mail and tracking wasn't getting updated for 3-4 days, then his box arrives empty, and he request i send it back.

After I send that he becomes stubborn and now says he won't be returning my knives until he gets his box back, which he could already have.
 
His latest email

"You do what you feel is right. I have nothing but your say so that you even returned the box. The only thing in the pictures was the stamps. How do I know you didn't keep the knives and know someone that can stamp it for you. I would prefer to get the box back and file my claim."

I am pretty confident I am now being scammed. I have pictures of said package I can provide as well. I'm also pretty sure i know the route lady and will see if she remembers delivering the empty box.
 
Did you let them know you're posting this thread? If not you should.
 
Unless there are some extreme circumstances, he needs to get to the post office himself and mail the right package. It's not his wife's responsibility to complete his transactions. Am I missing something here? He will get a few days to figure out what he wants to do, if he doesn't return your stuff he's out of here.
 
Looks like he checked in ten minutes ago and chose not to respond yet... That's a warning sign for me, I know if I was called out in one of these threads and was not guilty of doing anything I would want to clear my name as soon as possible.
 
What is he going to do with an empty box, what does it prove?
A photo accomplishes it all, the damn box is empty!!!! Yes folks, it is rocket science I say, Rocket science.
and we need a new GB&U sub forum called "My wife/girlfriend/ sister/brother/mother shipped the knife and I am not now BOUND by the written and more importantly UNWRITTEN rules of BFC.

Time to suck it up, it's not a Loveless level sale and ship the man his knife. make it a lesson learned on how to properly ship!!!

First off let me say that my wife has shipped every one of my 55 positive feedback shipments, and then some. We have had no problems up until now. She knows how to package a knife for shipping. The empty box is needed to file my insurance claim is what I was told when I called the Post Office. I have no control over getting that box back. Mr. Johnson did not give me the opportunity to send the money to have it shipped back with confirmation now if he did send it and it's lost like he claims I am out my money for the two blades sent to him. Ban me if you'd like I really don't care. I will send his knife back to him as soon as I get either the box or the knives. Until then I will keep it safe. We each take a responsibility when we choose to trade on the forums as I see it and it's his responsibility to make sure that I get the box back so I can file my claim. I had every intention of shipping the knife back to him but like I told him my wife does my shipping as I work long hours and can't get to the Post Office. She has been busy at work and hasn't had a chance to take care of it. Then when the box didn't show up. I started thinking that I may have been scammed. If I am a scammer as Mr. Johnson says then I must have been very good at it to fool 55 other people.
 
I marked your box as return to sender, as I have in the past when rejecting packages. Your box was empty and didn't require me even opening it to see that.

I also have pictures taken before returning it, and don't see what all the fuss is over a box. I have filed claims before and never once sent a box in. Your being pretty ridiculous to use that as your only form of defense.
 
Interesting. Was the package with no contents actually delivered or was it refused? This may make a diff to the PO - not sure. If the guy sent me pics of the box and stickers - I think I would just send him his knife back. Not like we are talking a $1000 custom here.

I recieved it at my work, my manager said I had recieved a box, and when I felt it new it was empty and then saw usps had marked it. At that point i email Terrence letting him know I recieved a box with no contents.
 
Legally it's as follows (I'm not a lawyer and that's not legal advice and don't sue me for trying it at home):
The sender is responsible for the item to reach the recipient unless stated otherwise.
So you can't hold his knife hostage for some box damage which happened before it reached him.
If he's nice he can help you to get the box to you. Morally he should and since you pay shipping I don't see why not.
