how do you know if your bidding on a counterfeit or not?

i may have gotten scammed on a benchmade that i just paid for the other day, the day after payment was made i see a negative feedback pop up on the seller saying that the BM that this buyer just received was a fake. in the auction there was a pic of the real knife with the box but in the desc. it read no box. im just wondering if any of you have any tell tell signs that a knife may be a fake. the few that ive picked up are:

1) is the pic of the knife from the guys home or stolen off another site?
2) is the box w/the knife
3) liner locked knives are the easiest to counterfeit - arc locks, axis locks, etc = probably not.

so far ive seen counterfeited:

1) the BM 910 that duped me
2) a buck strider and im sure there are others

luckily the seller has agreed to refund my money upon return of the knife but its gonna end up costing me around $12. i really like buying knives off the bay because you get the occasional deal but just want to insure that this doesnt happen again.
 
I rarely buy from anyone with recent negative feedback and rarely from anyone with a low number of sales or new account. When I do I always take a pic of the auction page (use the print screen button). This provides proof if the item is not what was advertised as many sellers delete pics after the auction ends to save ftp space. Always ask for the seller's return policy if not stated in the auction. If it says no returns I wouldn't bid. Beware of sellers using catalog pics rather than pics of the actual item you are buying. Catalog pics aren't necessarily a bad thing but when combine with any of the above it sets up red flags.

Don't hesitate to contact e-bay if you feel you have been the victim of fraud. I have had to do so several times and e-bay has always responded quickly and favorably. (last time was a rare cd made for radio station use and the guy sent me a copy of it, not the original cd)
 
well ive hunted this guy down, i have his full contact information and will be demanding my full return. i can threaten to file with the usps for mail fraud and the FBI for selling counterfeit products. if neither of my tactics work its gonna end up costing this guy alot more than what i spent because i reallydont get mad i get even X2 at least.
