Is there Justice in America?

Don, I hear you. Once again your posts provide much to think over.
My only point is that if you are going to break the law, no matter how arcane or inane, be prepared to suffer the consequences.
I am an officer who believes in the spirit of the law. As such, things are more open to my discretion, and that's the way I like it. But as you well know, there are so many police officers out there who are overzealous and will follow the letter of the law just to make an arrest.
I am often told that I am too nice when I do my job. But I also remember the words of a WW2 vet who crewed a B24 in the Ploesti Raid and later retired from a police department. Mr. Miller told me in effect, do your job, but don't be a prick.
Words I have taken to heart.

I know Phillip, usually, if I think someone is a prick, I won't even talk to them. I'll talk through'em. You know about that, because you're a LEO and you have to do that sometimes, if for no other reason, so you don't split someone's lip open.

I know when I worked for Wells Fargo Alarm, I had to deal with every lower life form you can imagine. The only people you meet in those types of Inner City Neighborhoods at 3:00am are Police Officers, burglars and rock monsters, that is after all, why I was there.

98% or better of the good folks are inside because they are sleeping or they are actively scared of their own environment and rightly so.

It's a hard thing to try and teach people to survive in that environment, I would hate to be an FTO. I trained a few people to perform Key Service, etc., for Alarm Calls and a few of them quit when the shift ended at 7:30am the next morning... I remember one young lady who was gnug-ho to be a Police Officer, she quit the next morning. Wanted no part of that job...maybe that saved her life later on too.

The debate over the Spirit Vs. Letter of the Law is always a great one. I think sometimes it is very valid as you suggest, like with street Cops. I think when it comes to Customs, there is not a whole lot of thought put into the Law at all, the Law was garbage when it was passed in 1958, I'm a Servant of it, and that is it.

Maybe they agree, maybe they don't. I don't know. But...what I was saying earlier about the black hat concept is, that sort of indifference is incredibly dangerous in society. We're supposed to be free, but sometimes I wonder how we can consider ourselves free when we have laws that state, this pocket knife is OK, this one is questionable and this one is prohibited.

It's just a pocket knife to me, always will be, it can never change. Because it is simply a pocket knife and not a symbol of evil to me.

I think what tends to piss BaliSong Fans off is, the BaliSong is the following;

1. Incredibly safe, the lock is as strong as your grip, even with a latchless or where the latch is not locked in.

2. Strong design, they do not usually break if they are finely crafted of good materials.

3. Still need alot of skill in order to open one fast. Versus a button or a straight drop Gravity Knife like the German Luftwaffe Knife and all variants of it made then and now.

4. Safest pocket knife ever devised when closed as well. The entire cutting edge and point are encased in whatever the handles are made out of.

All great attributes in a pocket knife. And to see those things go to waste, pisses some off and they lift their nose in the air...and I hate to say it because I'm not a criminal, but that indignation is righteous.

Nowhere in this whole debate does anyone speak of taking the life or property of another. No, the Government confiscates. If I do that, it is theft or robbery and illegal.

No one is arguing that a law against Bank Robbery or Rape should be ignored. Simply that incredibly stupid or Draconian laws should be thoroughly ignored in some cases...

Carrying becomes another issue.

It's very touchy and people tend to not care until it is something that they find useful or appreciate, that gets controlled, taxed or banned...targeted for legislation. That's natural.

Good conversation.

I wish there were more LEOs like you...like I said in the Emerson Forum, I think alot of people are retiring too soon.

>>what you did JohnR7 is actually quite commendable.. I doubt many people woudl spend the tie and effort - it is obvious you were standing up not only for yourself but for all us balisongs fans..

I am wondering if it really has to stop here though. The court dismissed the case, without prejudice, because they said they did not have jurisdiction. That is a pretty weak defense on there part as far as I am concerned.

The law is clear that I can have the knives transfered from the Port Authority in San Fransico here to the Port Authority in Cleveland, where the court does have jurisdiction. They just refused to comply with the law to transfer the case here.

Right now, sense Ebay locked me out, I have not even been selling many balisong knives. But like you say, this is a case for everyone, not just me. Also, not even just the balisong people. Knife people and people who work for a living and need a knife to do there job have been under attack from the government, to take away there tools. Also, the gun people should have a interest in this also. If you can not even defend your right to own a knife, how much more are they going to make it difficult to defend there right to own a gun.

But if people do not get together and organize, nothing is ever going to come out of this. I am thinking about going to talk to a few attorneys to see what it would take to continue on with this. Thanks, JohnR7

What you have to be prepared for, is to defend yourself in a court of law. Often courts are run on little more than popular opinions. It's actually not to difficult to control people opinions.

If I were in a position to enforce or defend the law, I would want to know who was defending me. People with little or no understanding like to attack "religion", but many of the top martial arts experts in this country are very interested in religious beliefs. They want to know for example, where did Samson get teh power and the strength to take on 1000 people all by himself.

Talk to a few people who have lived to be 80 years old, and find out what they believe. Look at a few people who died very young in life and find out what they believed. For me, if you can not figure out a way to obtain a long rewarding life with what we are given here, what hope do you have for eternal life.

I by the way am almost 50, I feel much younger than that. Actually, I was born again when I was about 30, so that makes me about 20 years of maturity. I am still alive to tell people what I think and what I believe. But I know lots of people who are not around anymore, to share with others whatever it is that they believed.

I agree 100% and I am very happy to see that the link to these things is viewed in the same light by you John.

And the same goes for a knife...
And, I'm a Usual Suspect.
Some of my Knives and other neat things

damn. well, here in MD, the laws are pretty ambiguous. gravity knives are outlawed, but there's a cloud over the line that may distinguish balisongs from gravity knives. it's never stopped anybody that i know from carrying, however, and since every cop i've asked has told me something different, i figure that since i haven't been instructed not to carry, i'll just carry my balisongs anyway and be careful/discreet.
and nexus, i'm a honky, so please don't kill the white man.
