Item lost in shipping

I purchased a knife from overseas via eBay.

Nine days later, the seller placed the knife in a 9x6" envelope of the sort that comes with greeting card (soft, thin paper) and mailed it from Finland. He did tape one end shut, but the envelope was otherwise not reinforced.

About four weeks later, the remains of the envelope arrived inside a USPS "WE CARE" envelope. The top and one end had totally split out and one side had split about 85%. The sheath was still there but the knife was gone.

The seller proposes that we should share the loss by his giving a partial refund.

I have literally never had a knife shipped to me in such flimsy packaging. The sheath does not fit any knife I have.

My position was that I should receive a full refund. I have had silence from the seller since.

What do you say?
 
Full refund is definitely and rightly deserved.

The seller is responsible for safe and adequate packaging...period.

But besides that, you didn't recieve the item you bought, so the seller owes you a refund no questions asked.

At the least it should of been insured, especially coming from overseas.
 
No Way- Full 100% Refund. I'd file a claim immediately. If he wants the sheath back he'll pay for shipping.
 
He failed to do what was necessary to get the purchased item to you, the buyer.

Full refund.
 
If he's not willing to give you 100% refund, open up a claim through ebay/paypal.

Shouldnt be a problem.

Wow, that is insane. That makes me wonder if the knife was even in the original package.

this is exactly the reason insurance should have been paid for by the seller to protect himself. he refunds you the full amount and puts in a claim to recover the money from the post office himself. everyone wins. if he didn't do that he can blame himself for taking shortcuts and getting stuck. happens to the best of us. learn from the mistake and move on.

to not give back your money is wrong, imho. guess i should ask how much money are we talking here. not that it should matter but is this over 25 bucks american or thousands american?
 
Full refund, how do you know he shipped the item and not just the sheath. Your job is to pay for item, his job is to make sure the item arrives safe and sound and as described. Keep all communication with the seller and put in a claim to get your money back.
 
Even if he bought insurance, I doubt any post office would pay, given the inadequate packaging.
The seller owes the buyer a full refund.
 
As already stated in this thread, you deserve a full refund if your description of the packaging is true. But you should do it ASAP before your not able to file a claim anymore.
 
Thats a very good point Esav.They woulden't of allowed him to purchase insurance to begin with I'd say.

Absolutely excellent points. Guess if the post office wouldn't allow insurance on the packaging......seller would have had to repackage it properly and problem wouldn't have happened. So insurance would have stopped the issue.:) maybe too much wishful thinking though on my part?
 
There's a lot of private sellers and at least one dealer I know of, that if you don't pay the insurance they'll say they aren't responsible if the item is lost. If you pay with pay pal they don't look at it like that and you can file a claim. But, still it's best to be clear about this matter before you buy something, as some just don't think it's the seller's duty to pay when lost, unless the buyer pays for the insurance.
 
I bought a Spyderco of a well known knifestore in E-bay. I bought it on 08/23/12 and the seller shipped it with USPS, got track/trace so perfect. But to this day nothing received ( 36 days and counting )... Track/trace only goes in the US, and I live in The Netherlands. The postal services are terrible. Have had much problems the last year or 2 with mail either being delivered at wrong address, or just gone MIA.... I have a feeling someone is very happy with a new Spyderco somewhere.... I hate the postal agencies.

Because of there screwups me and the seller have to work out a deal if it doens't get here fast...
 
He finally responded:
Sorry, but I am not willing to refund the whole payment. I will refund 30 dollars. In case you return the sheath I will refund 40 dollars. I think that the item is damaged partly because unnormally rough handling in transit. That is why I am not willing to refund your whole payment.

I have opened an eBay dispute and marked my calendar to send a payment contest to Discover.

The fact that the seller used such a flimsy manner of packaging for the item, along with a lack of insurance is reason enough for a full and complete refund. It's an unreal expectation to mail a heavy item in a simple paper envelope and expect it to make it overseas. He's going to lose.
 
The seller's "not willing to refund the whole payment," eh? Paypal will have something to say about that ;)
