On August 10th 2008, Greg Kruty and I agreed to trade my Oakley for his mini-manix. I shipped out my package on August 13th as agreed with USPS priority (01038555749365608450) and Greg stated that he shipped it out on August 12th (he did not provide a tracking number). The delivery cofirmation number was emailed to Greg by USPS.

On August 18th, Greg replied to my email to 1) confirm the receipt of the Oakley and 2)state that he has stopped the delivery of the mini-manix because my Oakley was not as stated (M-frame) and that he will be sending the Oakley back. I sent off an email the same day apologizing for my mistake (This was my first and only pair of Oakley so I relied on the information I was given when I traded for them.).

I sent an email later offering to reimburse him for the shipping fee if he would provide me with the cost.

I also started a thread: (http://www.bladeforums.com/forums/showthread.php?t=577585) on preparing to identify the Oakley once it got back to me.

As of September 2nd, 2008 (13 days later) I have not yet received the returned pair of Oakley or any tracking number for the package. Repeated attempts at communication with Greg ( 8/20, 8/26, 8/29) has also received no reply whatsoever.

As it stands now, Greg has confirmed that he received my Oakley but I have no confirmation of anything being sent out on his end other than that he claims my Oakley was not a M-frame.

I believe Greg has a good feedback as late as June of 2008. If anyone can still contact him, maybe he could be convinced to provide some tracking number so I can at least know where my package is.

Is it even possible to stop a USPS package during delivery? I thought once it was shipped there was not much the sender can do to stop the delivery, but I am probably wrong.....................

No it is not possible to stop a package mid-delivery, unless it's express mail. But even if it is, it will be hard to stop the package. I mean, what postal worker wants to actually track the driver/pilot down and call him to stop and turn around for one package?

In my experience with the postal office, I never heard of this of happening at all.

My guess is he did not even sent the mini-manix, if he even has one.

I hope this turns out for you, having stuff stolen from you sucks.

Thanks, that's what I had thought and based on your explanation it makes a ton of sense.

Greg stated that he sent it through Fedex Ground, I'm not too familiar with the working of the Fedex system.

either way I can't confirm the status of the shipment since he never sent me any tracking number.

Well, this seems pretty much an open-shut case.

Does anyone know if this situation is covered by USPS (postal inspector)? And if so, how do I go about to start the process.

If it is not covered, do I have any recourse?

Thanks

David

If the US mail is involved in any way that makes it mail fraud. You sent your half of the trade by US mail.

thanks, I'm going to pursue that route and see where it takes me.

I'm going to bump this thread if it falls off of the front page, hope that's ok with the mods.

End of September update:

Haven't heard a peep from Greg Kruty, I've filed with the USPS Postal Inspectors. I'll update if anything comes up.

It won't do much good talking to the USPS if he sent it by FedEx, and neither will be much help without at least a shipping date.

I have kept the receipt from that shipment so I have my half. I'm hoping (also from reading above) that since my half is shipped USPS this may fall with the postal inspectors.

I, at this point, doubt anything was sent to me at all, ever. Unless I hear otherwise, I consider my item to be stolen.

edited to add: Even if I can never recover my loss, if I can prevent one person from falling to the same trap with my thread, I would feel that this is worthwhile. If I had found a thread like this instead of the cheer thread while searching, I would not have made the trade.

I'm bring this thread back to life because it appears that greg kruty (same user name and email address) has appeared again on Candlepower forums selling surefire lights. I have made contact and he says he'll be sending the glasses back. I'll update any progress.

yeah, I did. He asked me to email him my address and he'll ship it out on Saturday. I emailed him earlier today. Let's see what happens. this is all in the post so at least it will be visible for all to see.

UPDATE:

on 3/3/2009, I have received my oakley back from Greg. I will be posting a thread later tonight to ask for help to ascertain the exact model of the glasses.

Did the Oakleys arrive on 3/3/2009, or is this just the date of the post?
